Increase in CCJ's

I have noticed that since I joined the forum a few years ago there seems to be quite an increase in the number of posters who have incurred a CCJ. This is a blight on their credit record and their ability to obtain finance, etc. In some cases it can effect their job opportunities. It takes a lot of unravelling as well. Some of the drivers affected by the Lichfield debacle have now received CCJ's.

In the Lichfield cases, was this because they lost/ ignored the claims/ didn't receive them?

I can suggest a number of reasons why this might be. Only a very small percentage of motorists receiving court claims, ever find their way to this forum, the vast majority blindly stumble on with no clue as to what they should be doing.

Many CCJs arise because the original PCN was issued some years ago, and the person has since moved house without realising that they have to update their V5C with the DVLA, as well as their driving licence, in a separate notification. Hence they are blissfully unaware of the court papers, until they apply for any form of credit.

Then there are those who think that the claim form from the CCBC 'doesn't look official' and ignore it, or chuck it in the bin. If they do bother to do any research, they may well come across the advice from the bloke in the pub, or some random posting on the likes of Facebook, which says that it's unenforceable because it's not a Council penalty, or that the parking company can't win if they don't know the name of the driver.

Another category is the people who don't assign enough priority to defending the claim, and get a CCJ because they missed the deadline for filing the Acknowledgment of Service, or their Defence. Or else they simply don't turn up for the court hearing, and inevitably lose.

Like most aspects of life, you can never underestimate people's ignorance and stupidity.
Just on that point ... if the address with DVLA was correct at the time of the PCN and the D has since moved, updating DVLA for the V5C is somewhat irrelevant because the PPC can only access DVLA data once per PCN. They can't ask DVLA again so the V5C data not being updated doesn't matter. :)

Does a subsequent "soft trace" get DVLA data at all?

Not sure of the circumstances but I know that some have received CCJ's.

When I first joined the forum there was an occasional poster who had received a CCJ. Now there seems to be at least one on every page and sometimes three. I guess that this is due to the increase in PCN's and the factors that Bargepole mentioned.

It seems dreadful though for the sake of a small trangression that is often not their fault people are having their credit ratings damaged and sometimes their employment opportunities. Unlikely to find employment in finance with a CCJ.

When people move they often use a redirection service which has probably expired by the time a claim form is received.
    Remember this ...

Theresa May vows to investigate ‘abuse’ of CCJ system

    https://www.dailymail.co.uk/news/article-3786132/I-ll-end-credit-rating-scandal-pledges-PM-acts-Mail-exposes-rulings-ruined-lives.html

Did she start the investigation ? if she did, it would have been passed to another minister and probably just filed away in a filing cabinet in Whitehall

Most CCJ's are by default because the person knew nothing about the court claim. Judges well know that a default judgement can lead to a CCJ

It's about time the courts/judges used the grey matter between their ears
and question WHY the defendent did not appear and what steps did the claimant take to prove they had the correct address.

  • @patient_dream Is that the same Theresa May who wanted to triple UK visa fees for non-EU/EEA applicants and had to be voted down to a compromise of doubling them by Parliament?

Is it it that Therea May you're referring to?
