    Send a short but sweet signed Supplementary WS tomorrow responding to that point and attaching the photo exhibits again but this time with time/date stamped on them, using:

    Android = Auto Stamper for Photo

    IOS =   TimeStampIt – Photo Stamper

    If you can't get them to work, screenshot your photos one by one which shows the time/date taken.

    Re the point that you had successfully used this car park twice before, was that even you, or is there a chance those visits were by another driver of the car?  Even if it was you, it's not reasonable to memorise location codes; that's what signs are for!

    Your email must go to the local court and to the Claimant's solicitors (assuming they are using solicitors).

  • Good good job @helpthisgirl. I love hearing that scammers have lost again in court and justice was rightfully served.

    Keep an eye out on the forum for the upcoming consultation on the new COP. This should help sort out the dodgy claims of the private parking industry in the near future.

    Where to start!! 

    There were a few swings and roundabouts but the main arguments that the claimant put forward was that the images I provided weren't from the exact date that I parked there but from 2 weeks later... 
    (Who takes photos in every car park they enter....)
    It was quite easy to point back to my Google street view evidence which shows the works going on in august and then the time stamped ones from October - Judge really didn't seem impressed by such a lacklustre argument and seemed cheesed off when they sought to rely on it after it had been made very clear. 

    The second key issue that they raised was that I had parked in the car park two weeks before but the judge was very satisfied by the point that it wasn't necessarily me driving (as I'm not registered keeper). Evidence also shows that the fences had been moved slightly so it isn't unreasonable to think it was less obscured two weeks before the offence. I said it isn't reasonable to memorise a location code and this was thrown back to the claimant. The judge asked 'would you be able to tell me the address of this court house?' 

    The claimant didn't include an image of the actual payment sign, just those with t&c's - judge was again really not impressed with. Plus they tried to rely on opposing evidence to the excel case but didn't include in their bundle so that was quickly thrown out! 

    I felt a bit sorry for the girl fighting the case, she was an advocate who had been handed the case last thing on Friday! (With 141 pages of evidence to read through!). Shows how little these companies care. 

    Anyways, topped off with a £95 reward for all my trouble. Perhaps I should divvy that out to you guys!! 😂

    We need you - as a genuine PPC victim of aggression, sharp practice and an 'extortion' attempt to add £70 - to respond robustly to the Public Consultation on the level of parking charges and banning of the false added DRA 'fee' that too many honest motorists currently fall victim to.

    It will need consumer input (powerful voices) but change is afoot. It's taken about 5 years to get to this stage:
