TERMS AND CONDITIONS for “Magic Radio x Walt Disney World” (the “Competition”).

 

These terms and conditions (the “Specific Terms”) for the Competition should be read alongside  our general competition terms and conditions at: http://www.bauerlegal.co.uk/radio-competition-terms.html (the “General Terms”) which will also apply to this Competition. Where there is any conflict between these Specific Terms and the General Terms, the Specific Terms shall prevail. 

 

 

1.ENTRY ROUTES AND COSTS	“Magic Radio x Walt Disney World’’ Online Prize:  Entries are restricted to one entry per person.   Entry to the Competition is available via the following routes:   Online at https://planetradio.co.uk/magic/   Online entry is free of charge.
2.COMPETITION MECHANIC AND HOW TO WIN	“Magic Radio x Walt Disney World’’ Online Prize:  There will be one winner of the Competition.   The winner will be selected from all those that correctly answer the competition question on the relevant online page.    All valid entries will be pooled and the online winner will be chosen by electronic random draw on Monday 26thSeptember 2022
3. ENTRY PERIOD	“Magic Radio x Walt Disney World’’ Online Prize:  Entries must be submitted during the following entry period:   From 24/08/2022 at 00:01 (the “Start Time”) to 25/09/2022 at 23:59 (“End Time”).   Entries received before the Start Time or after the End Time will be invalid.    Winner Announcement: The winner’s first name and hometown are available on request by emailing win@bauermedia.co.uk   However if the winner cannot be contacted within 28 days from the date of the initial attempt to contact them, then we will re-draw until we draw a winner that we are satisfied (in our sole discretion) fulfils all of the eligibility criteria and is in compliance with these Terms.
4. ENTRY RESTRICTIONS	Open to UK residents aged 18 years or over on date of entry.  Our employees (and their family members) or employees of any company involved in the Competition, including any Prize Provider, are not permitted to enter. We reserve the right to disqualify any entrant or winner who does not comply with any of the eligibility criteria and/or is in breach of these Terms. We reserve the right to repeat the competition mechanic or any stage of it in order to draw a winner that fulfils all of the eligibility criteria and is in compliance with these Terms. If you or any other person at your household has won a prize valued at £500 or more on any Bauer brand in the past 6 months, you nor they are not eligible to enter or win this competition. 5. THE PRIZE	“Magic Radio x Walt Disney World’’ Online Prize:  One winner will receive the following prize (the “Prize”):   Prize package includes:  Disney will provide the Promoter for the promotion “Magic FM  X Walt Disney World Resort” (the “Promotion”) with one (1) package holiday consisting of seven (7) nights and eight (8) days to Walt Disney World Resort in Florida for one (1) winner of the competition (Recipient) and three (3) accompanying guests, in total four (4) persons.     Up to Four (4) return Economy Class airfares between a major international airport closest to winner's residence in the UK and Orlando International Airport in Orlando, Florida, USA.    Up to Four (4) round trip ground transfers between the Orlando International Airport and the Walt Disney World® Resort in Florida  Room accommodation consisting of one (1) standard room (with a maximum of four (4) persons per room) for seven (7) nights at a Disney Resort hotel selected by Disney in its sole discretion; based on availability    Four (4) 8-Day Park Tickets with Park Hopper Plus Option.      One (1) Disney Gift Card with a value of $2,000. Subject to restrictions.       The Prize is provided by Disney (the “Prize Provider”). We are not responsible for any aspect of the Prize, including unsatisfactory quality or late delivery or a prize winner being unable to take up any aspect, or the entirety of the prize due to their own circumstances or restrictions.      PRIZE PROVIDER PRIZING TERMS AND CONDITIONS: Prize must be taken between 25th November 2022 and 30th September 2023. Departure date and accommodations are subject to availability. The booking form must be received back a minimum of 60 days out from preferred travel dates.      Any costs incurred in addition to the Prize elements listed above shall be incurred at the Recipients’ and/or their guests’ expense including but not limited to: UK transfers, meals, hotel room service, laundry service, alcoholic beverages, merchandise, souvenirs, local and long distance telephone calls, tips, gratuities, service charges or taxes and all other charges and items not otherwise described in the above.     Minors under the age of 18 not travelling with a parent or legal guardian must be accompanied by an adult over the age of 21 in the same accommodation.     The Prize is for the Recipient and up to three (3) guests of the Recipient’s choosing.    Travel insurance is not included. It is the Recipient’s responsibility to take out before travelling adequate insurance suitable for their needs for the entire duration of the Prize. Disney shall not be liable for any costs or losses through the Recipient’s failure to take out adequate insurance cover.     The Recipient and all of their guests must travel at the same time on the same routing. Any children in the group must be accompanied by their parent/legal guardian aged 18 or over.     The Recipient and their guests are responsible for their own passport, visa requirements and any other documentation or any other requirements (including but not limited to Covid-19 testing) that may be imposed by the authorities from time to time.     It is the Recipient and their guests’ responsibility to comply with the applicable laws and follow the Foreign Commonwealth and Development Office’s travel advice in respect of Covid-19 which can be found at https://www.gov.uk/guidance/travel-advice-novel-coronavirus.     Age and height restrictions may apply to some attractions. Parks, attractions and/or entertainment may change operating hours or be closed due to refurbishing, capacity, weather or special events and may otherwise change or be discontinued without any notice and without liability to the Supplier.    The Prize and all elements within may not be sold, traded, transferred, rescheduled to dates not within the fulfilment period set forth above, or refunded.     The Supplier reserves the right to substitute elements of the Prize at any time or postpone the trip, including but not limited to the closure of Walt Disney World Resort or any unavoidable and extraordinary circumstances.     There is no alternative prize and the Prize cannot be exchanged for cash or an alternative prize.     Once the booking is confirmed, the winner and their guests are subject to the travel conditions of the airline.     At present, to gain entry into a Walt Disney World Theme Park, advance registration is required. It is the Recipient and their guests’ responsibility to make reservations for the Theme Parks that they wish to visit using the Disney Park Pass Reservation System. The recipient must make a separate reservation for each date they plan to visit, even with a multi-day ticket at each Theme Park they wish to attend. Disney cannot be held responsible for the Recipient’s failure to make reservations and will not be able to change travel dates once travel costs have been incurred.     If the winner elects to partake in any or all portions of his/her prize with fewer than three (3) guests, the prize will be awarded to the winner and any participating guest and any remainder of the prize will be forfeited and shall not be subject to further or alternative compensation.    Enhanced health and safety measures are in place at Walt Disney World Resort to promote cleanliness, physical distancing and reduced contact. Some experiences, shows or events may not be available or may be modified depending on the evolution of the safety and sanitary measures and recommendations from public authorities or other reasons, including but not limited to adverse weather conditions, refurbishment or maintenance. Some hotels may be closed during some or all arrival period.  Details available at disneyworld.co.uk.     Disney cannot be responsible for any unforeseen cancellations of flights or other arrangements.    Disney, its parent, related, affiliated, and subsidiary companies and their respective officers, directors agents, employees and assigns shall be released and discharged from any and all legal claims, losses, injuries, demands, damages, actions, and/or causes of actions that arise out of and/or in any way related to the prize, the receipt, use and/or enjoyment of the prize and/or the Promotion.    By participating in the Promotion Recipients and their guests agree that they will be subject to Walt Disney World Resort Booking Terms and Conditions save for the sections relating to the fees of booking. 1. DATA PROTECTION. Names, email addresses, and /or telephone numbers (which, for all SMS competitions, will be shared with our SMS provider) will be collected and used to process entries. Winner’s details may be given to a Prize Provider to arrange delivery of the prize.  Your details may remain stored after the End Date but will not be used for marketing unless you have ticked an opt-in box on entry. 1. INTELLECTUAL PROPERTY AND CONSENTS. By entering this Competition, you are consenting to our use of your entry both to publicise this Competition, our radio station or any other radio station which we own or control. This means that we may use all names, images, descriptions, photographs video footage, and other information, which you have submitted on entry, in any media, without paying you any remuneration therefore and without any time restriction. You also agree that we may film, record or photograph you in connection with the competition and /or the Prize if applicable. We will own these films, recordings or photographs and we may use them publicly, including on the internet, for our radio broadcasts and/or for any promotional purposes. You will also have waived any moral rights or right to payment that you may have had.

 

1. MISCELLANEOUS.

 

• Entries which do not comply with these Terms or the General Competition Terms and Conditions will not be accepted and any entries may be disqualified if we have any reason to suspect that there is a breach of, or non-compliance with, these Terms.
• Where a competition mechanic involves the answering of questions, the correct answers to questions must match our answers to win (or be sufficiently close in our sole reasonable opinion) to be acceptable. In the event of any dispute about any answers given and whether they are correct, we reserve the right to amend what we deem a correct answer, however we are not obliged to, and our decision in either case is final and no correspondence will be entered into. 
• We are not responsible if you fail to get through when you call / text to enter, or if you lose signal during a call. 
• You are responsible for all costs of entry and where necessary, obtaining the bill payer’s permission. Please refer to your tariff with your network provider for information about charges you may incur for entry into our competitions via any SMS or phone call entry route. 
• We accept no liability for network, technical or signal errors, issues or failures experienced by entrants when entering the competition or at any stage during the mechanic of the competition. 
• Whilst on-air, you must not make any inappropriate, profane, indecent, harmful or offensive statements. If you do so we reserve the right to take you off-air immediately and disqualify you from the competition. You may be also disqualified from the competition at any time if you are incomprehensible, inaudible or if you appear to be driving, intoxicated or likely to offend listeners. Any prize already won may be withdrawn and re-awarded to another entrant.
