IVA completed but still being persued?

Hi. I was recently discharged from my IVA earlier this year and have recievd my completion certificate. However, I am still being persued for a debt orgiginally with Uncle Buck (pay day loan) which was transferred to a collection company called Conexus. The account was still with Uncle Buck when I entererd my IVA and I've just checked and it was included in the proposal eec.

I have tried calling Conexus but they never pick up. They have now sent me an email saying as no payment arrangement was made, if I don't make contact by 25th Aug they will escalate it to their field recovery team who will send someone to my address.

Where do I stand with this? Who do I seek advice from, original IVA company or Sprout Loans (who I took out a special IVA loan to pay it off? Thanks.

    Its quite common for insolvency debts to be sold on during the term of the arrangement.

    You have nothing to worry about, as this new company has no remedy against you, the debt was included in your IVA, and is now written off.

    Don`t even bother trying to phone them, that will not be productive, as even if you get though, all you will get is the call handler, not the entity who you need to be communicating with.

    Send them a letter, inform them the original debt with uncle buck, that they bought, was a qualifying debt in your recent IVA, which successfully completed on (insert date).

    Therefore the debt they are chasing was subject to successful insolvency proceedings, and is no longer collectable, send a copy of your completion certificate as well.

    Instruct them that any future collection activity will result in a formal written complaint, which will, if necessary be escalated to the FOS with the intention of seeking damages for ignoring fare debt collection practices.

    End your letter by telling them you now consider this matter closed.
