Sofology won't accept cancellation??

Hi, advice, please.
I ordered a sofa and a chair in March, with a 10 week delivery promised.  10% deposit paid and interest free over 24 months arranged. I waited 13 weeks, as I was a bit busy then emailed.
Next day, email arrived asking me to call and book a delivery slot.
Delivery booked for 2nd July.
Removal of old sofa paid for as part of purchase, and this was done in late June, so only a few days without a sofa.
Delivery on 2nd July: chair missing and sofa wrong colour.
Many phone calls later, I 'need to place a whole new order which will be another 12 weeks'.
I said I couldn't wait, and asked to cancel the order.  Email received saying case 'resolved'!.  Called again, and was promised ( in an email) someone would be in touch within 4 hours.
2 weeks later, I received a phone call telling me I cannot cancel (I asked for this in an email, which has been provided).

If I 'reorder' I will have waited about 8 months.

Advice, please?

    I think there are two things to consider here, your consumer rights and the practicalities of the situation.

    Your right to cancel will depend upon the nature of the sale.  If you ordered online, without having visited a physical store, you may cancel within 14 days of the items arriving.  Assuming you visited in store, your rights to (and consequences of) cancellation will be in the terms and conditions you should have a copy of.

    Practically, aren't you better off waiting?  If you push for a cancellation and it happens imminently, they'll take away the sofa you have, and the chances are that any retailer has a long lead time for furniture orders at the moment, so you may be worse off.  The prices may have risen in the time since you ordered as well?  Aren't you better off re-ordering, and trying to negotiate keeping the current sofa until the new one arrives, and asking for a goodwill discount?

    Assuming they left the wrong sofa and it wasn't refused.  "Only a few days without a sofa" kind of implies they have one now, but could refer to what their belief at the time was.

    As "Removal of old sofa paid for as part of purchase", was there a set amount for that?  Because that part of the purchase has been fulfilled.

    Hiya, I tried to refuse it but the delivery chap got a bit funny, so I didn't push for it to be taken away.  Sofology have said it's mine 'to use and they understand it woll have some wear and tear when taken back'.
    I should have insisted...

  • OP if the sofa is the wrong colour tell the company you are "exercising the short term right to reject all the goods on the order because they do not conform to the contract".

    Do this in writing and don't mention the word "cancel" :) 

    This assumes you don't want them to replace, if you do then it's probably a case of having to wait but perhaps haggle for a discount (goodwill so no right to this).

  • I would push for some discount - but if they’ve left the wrong colour sofa there for you to use it’s not the end of the world. 

    I’d wait it out - it being the wrong colour for a few months won’t kill you
