Hello, I received my memo of sale on a property at the end of July. I now have my mortgage offer, and a homebuyers survey. The solicitor is undertaking the searches, and waiting for these to be returned.
My very basic question is:
- the survey raised a few issues, mostly straightforward, but two of which will likely require tradespeople to come in, one of which I am hoping the vendor will pay for (hopefully minor cost, boiler related). What is the normal process for taking these issues forward? I asked the solicitor, and they said they will raise any of these issues with the vendor's solicitor once the searches have been returned. I guess this is standard process? Just want to check it isn't slowing down the process by not raising survey issues straightaway.

If you had a basic survey, there’s nothing the surveyor can advise on the boiler. You’d need to pay to have any checks done on it, not the vendor. Assuming they’re living there then then probably don’t have an issue with it.

No the vendor doesn’t live there.My question wasn’t actually specifically about the boiler, I’m on top of what I want to ask/need there - it is about the process to raise these issues. Is it normal to wait and have the solicitor raise all survey queries at the same time as enquiries relating with the searches?1 -
Depending on what the issues are, you can raise them via the EA. You'll probably get answers much more quickly.
But information you get via the EA won't form part of the contract. Information you get via the solicitors will form part of the contract.
So for example, if you ask "has the boiler got a warranty" via the EA, and the seller fibs - you'd have no basis for suing the seller later. But if you ask via solicitors and the seller fibs - you'd have a basis for suing the seller later (if you suffered a financial loss as a result of their fibs).

Those sorts of queries will typically be raised during the enquiries phase. The reason your solicitor wants to wait until the searches are returned is because the results of those may throw up additional questions for your seller, and it’s best practice for your solicitor to try - as much as reasonably possible- to send all the enquiries in one go, as opposed to drip feeding them whenever a question comes up. Standard practice.0
