Hello all,Just wanted some advice please.I sent an email to the CEO of Optivo who forwarded the email on to the manager of the property in question who said they would try to help. Today I've received a response saying they cannot do anything more to help as they have received the below from UKPC.“As we had issued the claim to the motorist it is too late to cancel / discontinue at this stage as the defendant has acknowledged the service and they have right to file a defence before any further action can be taken – no matter what that action may be.”Are they really unable to cancel at this stage?0

They can discontinue up to the moment they walk through the courtroom door (although a judge may take issue with them leaving it so long); what they mean is, they have spent money on the claim and the want their pound of flesh!2

Some good news! After 5 long years, countless debt collector letters and eventual court proceedings, the charge has finally been cancelled.
Years after originally contacting the deputy building manager and getting nowhere, I got in touch with the CEO of the housing association who forwarded the email to someone with a heart who actually listened to me and went out of his way to help me. He managed to get it cancelled a day after I spoke to him which was amazing. The previous managers I spoke to fobbed me off, refused to help and ignored me so his kindness went such a long way.
I completely wrote off getting help from the housing association because the deputy property manager matter of factly told me there was nothing more they could do and the longer I delayed paying it, the higher the charge would be. She was blunt and unhelpful and further emails were ignored so I gave up thinking they couldn't help me, but contacting the CEO years later did the trick. The person he forwarded it on to sent the email to the building manager who was more responsive than the deputy building manager I spoke to years earlier but they still arrived at the "there's nothing more we can do" conclusion. Thankfully the gentleman the CEO forwarded the email to, got back in touch with me after seeing the response I received and not so surprisingly, there WAS something they could do... sigh.
It's good that after my experience, they're changing the way the carpark is managed. It's still nowhere near enough, but the changes would hopefully mean no one else will have to go through what I did at this particular car park.
I want to thank everyone on this board that does so much to help people receiving these ridiculous charges. If I hadn't stumbled on here years ago, I would have paid the charge because it was honestly giving me so much stress and anxiety and I just wanted it to be over but thanks to the wonderful support and advice here, I stuck it out.

Well done, and thanks for letting us know. Do make sure you get a letter of discontinuance from the claimant and/or court. Assume the case is still going ahead until you get it.
If it is not forthcoming in the near future, then send a copy of your correspondence to the PPC and their legals telling them the principal has instructed the claim to be cancelled now, so they should do so in order to save themselves money.
I'm sure you have already done it or thought of it, but a quick thank you to the CEO will encourage him to intervene in similar cases.
It would help us to know his name as well in case others end up in a similar situation.I married my cousin. I had to...I don't have a sister.

Have they discontinued the claim and you know for sure that the CCBC has that notice? If not, later this month you could lose by default because the ball was/is (and remains) in your court to file a defence as far as the CCBC is concerned.
If you are certain and have seen the Notice of Discontinuance - then great!!

We need you - as a genuine PPC victim of aggression, sharp practice and an 'extortion' attempt to add £70 - to respond robustly to the Public Consultation on the level of parking charges and banning of the false added DRA 'fee' that too many honest motorists currently fall victim to.

So was it UKPC or DCBL with one word .. "DISCONTINUE"
Sadly the BPA and the courts know UKPC ARE TRYING TO CON YOU and it's such rubbish that now makes the BPA as the head honcho scammer
