    Got a response today and was really disapointed. Seemed they don't want to contradict their own people... Their response below:

    Your complaint about POPLA

     

    Thank you for your received 17 August 2022.

     

    I note from your correspondence that you have now had the opportunity to review APCOA’s case file and provide your comments.

     

    POPLA is an impartial and independent appeals service and we do not act either for the parking operator or the appellant. It is important to explain that we offer a single stage determinative process and we would not change a decision because either party disputes the assessor’s decision. However, we may consider an appeal if there has been a procedural error, for example – if we failed to consider evidence provided by the motorist.

     

    It is also worth explaining that my role is not to determine if the decision is correct, but to establish if the assessor has failed to follow the correct POPLA process and identify whether a procedural error has occurred.

     

    I have reviewed the assessor’s decision and your additional comments provided after reviewing the case file and I do not consider these comments to have any impact on the outcome of your appeal.

     

    On reviewing the decision, I am satisfied that the assessor has provided a clear rational for refusing your appeal and has considered all of your grounds of appeal and the evidence that you provided. I am further satisfied that the outcome reached is correct and that no procedural error has occurred. As POPLA is a one-stage process, there is no opportunity for you to appeal the decision.

     

    I note in your comments you raise additional grounds of appeal that did not raise with your initial appeal such as the signage not being visible during the hours of darkness.

     

    As a one stage appeals process, we cannot consider new grounds of appeal once we have made our decision. As such, I am unable to comment further.

     

    As our involvement in your appeal has now concluded you may wish to pursue matters further. For independent legal advice, please contact Citizens Advice at: www.citizensadvice.org.uk or call 0345 404 05 06 (English) or 0345 404 0505 (Welsh).

     

    In closing, I am sorry that your experience of using our service has not been positive. We have reached the end of our process and my response now concludes our complaints procedure. I trust you will appreciate that there will be no further review of your complaint and it will not be appropriate for us to respond to any further correspondence on this matter.

    So they think it's OK for a parking firm to operate with ONE SIGN out of twenty that actually mentions the £80 contractual sum!

    Have you already sent me a pm about this case? Please do, if you are happy I include it in my complaint to the BPA that I have started to draft but haven't sent yet. They do listen to me. 

    Am speechless tbh. I even told them I paid for the 3rd time where I stopped and not the earlier ones, and POPLA even concluded that the previous ones was under 5 mins and does not count... It seem that they forgot what they wrote as they go along typing their response.

    BTW, to make matter more interesting, i just got another fine from ASDA. Aparently i parked my car there for 6 hrs! I will deal with that separetely! What make it funny is that only yesterday I read about someone being fined by ASDA for aparently similar offence, and when checking, ASDA's camera are quite selective what to capture and what not!

    Re the APCOA one you obviously ignore them.

    Re the ASDA double dip you complain to Asda first (Head Office) and tell them ParkingEye have failed to check for orphan images (use that phrase) and have negligently allowed a PCN to be issued with no human checks, when in fact that the car left at around (time) then returned at around (time).  In short, this was two visits, and no breach at all.
