Armtrac Security Services - Sennen Car Park

Hey all,

I have read through quite a lot of the information on here and was wondering if someone could give me some advice as to what to do regarding a recent parking ticket?

I was on holiday and paid for a full days parking at Sennen Car park, the payment went through and the machine did not issue a ticket. I thought nothing of this, as I had entered my registration into the machine (like most car parks I had parked in in Cornwall which didn't issue a ticket either) and just thought it was like all of the others.

I returned shortly after parking and paying for my ticket (I'd forgotten something in my car) and saw that I had been given a ticket - they must've literally been sat in a car in the car park it was that quick!

Spoke to Armtrac on the phone, explained the situation and was greeted by what can only be described as one of the rudest people I've ever spoken to on the phone and they just told me to appeal it. Obviously I appealed and it was thrown out as they're saying I didn't display the ticket and should have called them when a ticket didn't come out of the machine.

I am just wondering where I now stand with this. I really don't want to pay the fine, but also don't want to risk it going to court and ruling against me. I have contacted my bank and have proof of payment, we also paid for second ticket as we paranoid that they would issue a second penalty notice after the less than polite troll on the end of Armtrac's telephone line threatened this.

To summarise in my defence I have proof of payment twice, once before the ticket, once after. My banking app did not have a timestamp for the transaction before, but I'm sure this must be available somehow if it was needed as proof.

Any advice from more experienced people on here would really greatly be received.

    Why? That's when these cases are won!

    Are you (wrongly) imagining that there is risk - of high costs or that you get a CCJ? Neither is risked by people we help here every day.

    The NEWBIES thread second post tells everyone there is no risk in defending a case even if you lose.

    Are you (wrongly) imagining that there is risk - of high costs or that you get a CCJ? Neither is risked by people we help here every day.

    I was imaging that it might go against me because I didn't display the ticket/call to say it hadn't printed one.

    Also seach the forum for Sennen car park, sort by most recent. We've had a lot of cases there recently and even ended up getting them reported in the press.

    Do, find the dodgy ticket machines one. There are some excellent photos in there showing the signs and ticket machines. Your defence could well be that you assumed you were in "possession of a valid e-permit" per the displayed terms and conditions.

    I think you should nail this.
