If a person joins the forum and engages with the process from when they receive the PCN through to the hearing there is every chance that they will be successful at court. If a person loses and pays within the timescale (about 28 days) then they will not incur a CCJ.gwynfil said:Thanks everyone. But nobody has answered the actual question. If a person ignores the claim and the claim goes to a default judgment and payment is not made according to the judgment then this will result in a CCJ on their credit record and they may be chased for payment of the debt.

Yes, hundreds, or more, people win cases in the County Courts every day against these private parking companies.

The County Court Business Centre does not 'dish out' CCJs.
CCJ = County Court Judgment. No Judgment is made at that stage.
All the County Court Business Centre ('CCBC') does is facilitate a Claimant issuing a Claim.
A County Court will still decide the merits of the case.

There is one caveat to that... if, as you appear to promoting, no response is received to a Claim sent by the CCBC to a Defendant, then the CCBC can, through a Judge, make a Default Judgment against the Defendant.
Can I respectfully suggest that if you have any further questions about the legal processes of the County Courts that there are better places to progress those issues than a forum dedicated to parking?

Certainly off-putting for anyone expecting to reply in a timely manner to what looks like nothing more than a scam.0 -

They are real claims and once you defend, the case is allocated to your choice of local court, which then hears the case. As long as you defend.
We do this every day here and 99% of cases are won on this forum. I have gone to court in Sussex for several people as a lay rep and I've never lost a case.
They all start with the CCBC and if you fail to defend you will get a CCJ.

Yes. I won at Luton County court back in March against One Parking Solution where I was awarded costs for having my time wasted (had to take a day off work). This was exactly 3 years after I allegedly "parked and failed to pay". I've also had 2 other wins by cancelling with landowner and appealing to the parking company calling out their scam which was apparently an "honest mistake". If you stick around, listen to the advice here and put the work in you'll be fine 🙂3
