Reason for cancellation of ticket?

Hi all, my elderly Mother has received a ticket today from Parking Eye. It came via post. Long story short, she paid for 3 hours of parking expecting to be a couple of hours max but suffers from asthma and suffered from an asthma attack when out and about. She returns to her car around 3.30hrs. Is this sufficient grounds for the ticket to be cancelled/appealed? What type of evidence would need to be provided?

Thanks for that. Is it worth appealing to POPLA? It says on the ticket they will not consider an appeal if already appealed to Parking Eye. Thanks again for your help.0

You can't appeal to PoPLA unless an appeal has been made to ParkingEye, they have rejected it, and provided a PoPLA code.
Plan A is for your mother to complain to the landowner and her MP. If that doesn't work then she should appeal using the template in blue text found in the sticky Announcement for NEWBIES, and add a paragraph that the driver suffered an asthma attack thus causing a frustration of contract. Include proof of the medical condition as already advised.I married my cousin. I had to...I don't have a sister.

PE can be reasonable at times where elderly/medical cases are involved. But you'll (or particularly your mother - you can't do this 'on behalf of') need to appeal using the NEWBIES FAQ Announcement, first post, blue text template and copy them evidence of her medical condition.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I posted a while ago regarding a parking fine from Parking Eye which involved my kederky Mother and her being late other car after having a medical episode. We sent off the proof of this (prescriptions etc) to which they have come back saying this is not acceptable to cancel the fine....
Its rates on their email reply to the appeal that if we appeal to POPLA then the fine will keep increasing. Is it best to just pay it now?We previously sent a short letter with no notice of who was driving and copy of her prescriptions relating to her medical condition.

Ultimately I suppose what Im asking is will POPLA decline the appeal because ultimately she was late back but reply through no fault of her own.0

POPLA codes keep for a month. Plenty of time to get it cancelled.

Following the newbies section letter and attaching evidence of her medical condition Parking Eye came back to say the appeal was declined and that any unsuccessful appeal to POPLA would result in the ticket increasing from £60 to £100.
I have since gone back to the Landowner again and await their reply but Parking Eye seem adamant that a medical episode is not good enough reason for an unwell pensioner returning to their car late!!!0 -
