Letter before claim

Hi
In April this year I received my first parking change from Premier parking enforcement for what I have found to be a fluttering ticket where my ticket fell off the dash board.
I have read newbies and faqs but apologies in still a little unsure on my action required.
Before finding this site, I appealed thinking a common sense approach would cancal the pcn but no and followed up to the IAS
only now reading how bad they are.
As an honest person I filled the companys appeal and ias which I named myself as the driver something which I feel I should have avoided.
Anyhow, the parking company sent me a reminded letter to pay the £100 and on July 28th Gladstone solicitors have sent a letter before claim to me.
Can anyone support or offer any advice on my issue.
Many thanks for your time reading and help

Hello and welcome.
The first few paragraphs of the second post of the NEWBIES thread explain exactly how to react upon receipt of a Letter of Claim.
That image you have shown us does show your full name and the vehicle's registration mark.2 -
Hi
Just a quick update. I have received information from the parking company with my sar request but they have responded with the following for my request for PDT record for the day.
"PDT record irrelevant as no ticket on display in accordance with terms and conditions"
There's also a couple of queries I have if anyone can help?
My first and only letter from parking company said the outstanding charge could increase to £160 if they send to a debt collection agency however, I haven't received any debt letters and gladstones are asking for £170 which is titled as above letter before claim.
Kind regards0 -
Challenge the refusal about the PDT data and tell them it is not 'irrelevant' because you did pay and display and their machine records are needed to show if this was merely a VRM keying error. A partial VRM or one with a typo is still easily recognisable to relate to your payment of £xx and thus you need to see that data because it is yours.
Also write the same request to Gladstones but say you want the machine logs from the material time (with partially redacted VRMs of other matched cars) under the rights for Defendants set out in the PAP for debt claims. Finish by saying you will report Gladstones to the SRA if they refuse because it is key to the case to see if there was a VRM typo against the payment made, not just a fluttering ticket.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Many thanks for your help @Coupon-mad. I have sent the two email request over to both parties.0

I have previously sent a complaint to my mp regarding my invoice which ppe have rejected the mps request to cancel the pcn.
@Coupon-mad I have seen on your post to add additional information to gladstones via this post https://forums.moneysavingexpert.com/discussion/comment/79119887#Comment_79119887
At present, I have sent to gladstones"Hi,Your client has responded to my SAR request but not provided PDT data. I have sent the following to your client."I note in your response to PDT data you have said "PDT record irrelevant as no ticket on display in accordance with terms and conditions" .I disagree with this refusal and find it not irrelevant as I did pay and display which I have previously sent a copy of my ticket over to yourselves. The ticket was purchased on 23rd April at 14:00 for a fee of £4 with my vehicle registration number plate **** ***. I request this data as it is mine."I request to have the machine logs from the material time under the rights for Defendants set out in the PAP for debt claims. If this refused, I will be reporting Gladstones to the SRAYours faithfully,From:Sent: 09 August 2022 13:07To: enquiries@gladstonessolicitors.co.uk <enquiries@gladstonessolicitors.co.uk>Subject: Dispute debtRef:(a) I am seeking debt advice but I deny anydebt and the case must be put 'on hold' for not less than 30 days under the PAP for debt claims 2017.(b) I have sent your client a SAR"
Is it worth me sending additional information from your post regarding the additional fees currently requesting £170 or leave it as it is for now.0 -
Leave it as it is, partly because the plan to ban the fake DRA fees is on hold at the moment, pending an Impact Assessment .PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi - I'm at a similar stage to mozzer so thought I'd tag on to this thread. I got my letter before claim yesterday (have read the Newbies thread #2). It is from VCS's litigation department, rather than a separate solicitor. Do I still email them in the way you suggest emailing a solictor and then just await the MCOL?
Also, I did go through the IAS appeal, so have actually got all the photos etc from VCS, but should I still do a SAR?
Thanks

What you do is read the thread, take any advice from it, read the NEWBIE sticky and then please start your own thread as it is confusing trying to advise two posters on one thread.2
