  • Some further info, i am no longer the hirer of the said vehicle from BMW.  Also BMW transferred liability to me, by stating in letter "we have given your details to the relevant authority transferring liability of this offence to you.  The authority will now contact you directly"

    I have tried to appeal online, and get the following message 

    This Parking Charge Notice is currently not eligible for appeal, due to the following reason:

    Unfortunately we are unable to accept this Appeal as the Parking Charge Reference number has now been referred to our Debt Recovery Team.

    Send them a letter then, attaching what we advised you to attach when we said you needed to respond when you got the NTH.

    Because you wrongly ignored the NTH, you are now in danger of UKPC or their agents sending the next letter to BMW again, and they'll pay it and bill you over £170 for BMW paying something that you need to be in charge of & ignoring (BUT ONLY ONCE YOU'VE HOOKED IT IN YOUR DIRECTION).

    As we are now on p2 of your thread I will just add a reminder to every reader that this is a Scottish hirer case.  Hence why all the OP needed to do was respond to the NTH to hook it away from BMW.

  • Thank you for the advice.  I will get appeal letter written.  Is it worth me phoning the fines team at BMW to try steer this back to my direction again?  ( I did not realise that BMW could pay the fine if contacted again )

    Ask BMW what they will do if a debt collector sends a letter demanding £170. Almost certainly they'd STUPIDLY pay it and charge you, with bells on (a hefty admin fee on top).

    If the parking company, having written to you, get no response from you, then they will revert to getting their money from BMW. BMW will then pay whatever is demanded of them and then bill you for that plus BMW's costs in dealing with the matter.

    If you 'phone BMW, get the name of the person you called and follow it up with an email. Better yet, contact BMW in writing instead.
    A 'phone call is not worth the paper upon which it is writ.

    You should remind BMW that under Scottish law they are not liable and never were, so instruct them not to pay this charge. Warn them that if they do it is nothing to do with you and they must not charge you for their incompetence or ignorance of the law. Make sure it is all in writing and keep copies of everything you send.

    Looks like BMWFS are behind the curve when it comes to differentiating between fines and invoices.

    Latest letter received this morning.

    I have received a letter from ZZPS Limited who have been appointed by uk parking control limited and are looking to recover payment in full of £170 to avoid progression to GCTT certified enforcement agents....

    "it is our understanding that our client has sufficient evidence to pursue this matter through the courts and will do so if necessary."

    Do i still get in touch with BMWFS in writing?  I assume email would suffice?

    You ignore powerless debt collectors as already advised in the sticky Announcement for NEWBIES, contact BMWFS as already advised, and send an appeal by email or post to UKPC as already advised.
    Contact must only by from The Hirer and confirmed in writing.
    Do not use the word fine, penalty, offence, or authority.
    You are dealing with a completely unregulated industry referred to as rogues, scammers, and bloodsuckers by MPs across all parties and all nations within the UK.
