Ringo App Error

Hi. Just received a NTK from Ipserv. The driver of the vehicle parked and then paid for 3 hours parking via Ringo App. After 2.5 hours the driver tried to extend the session on the Ringo app but the app kept saying there was an error. Tried several times but did not work. Is there any defence as Ipserv’s third party payment provider failed?  Or should the driver just use the NTK template? If so should this be used upon initial appeal to IPserv or wait until it is appealed to POPLA?  Thanks in advance.

  • Thanks. Have looked through the Ipserv posts but could not find anything relevant. Have also searched the other threads but could not find anything. The NTK has arrived within 14days so wanted to see if the fact that their 3rd party payment app was faulty/not working (after initially paying via it) was a defence?  I will appeal whatever as don’t think it is fair as I tried to pay just wasn’t sure whether to use a template at this stage or wait for the POPLA stage?  Thanks in advance.

     I would complain to my MP and Trading Standards.  You have not breached any contract AFAIIA.  I am sure a judge would agree with me.
    You never know how far you can go until you go too far.

    You need to get an initial appeal in first before you have any prospect of getting to POPLA. Just use the blue text appeal from the NEWBIES FAQ Announcement, first post.  You can state in that if you want to make the point (without identifying the driver) that their agent's technology didn't function, but it will hold no sway. 

    Neither will POPLA uphold on that point.  You need to look at the NEWBIES FAQ Announcement, third post, and the later stages of the POPLA Decisions Announcement to see the examples of winning appeal points.

    Ipserv have had many complaints in our area

    One of the car parks in particular is a terribly maintained car park, a patchwork quilt of various surfaces, poor markings and signs placed low down on planters.

    Ipserv run from the local council offices, but not the council directly and from what I can work out the land is owned by Ipswich borough holdings, which is likely how they get away with running the car parks in this way. They’re as bad as most PPCs we see on here unfortunately.
