They also said that Smart P would have proof of franking the original charge notice and they would be recommending their client (Smart P.) take it to court.BS! There will be no records of franking individual envelopes, and DRP won't be recommending anything to SP. SP's court claims are rarer than rocking horse sh*t, and they won't be taking a single PCN to a court hearing. They may huff and puff through a low-rent roboclaim legal, but you just need to look at the number of SP cases that have gone the whole way to see just how unlikely court is.Do you enjoy seeking needles in haystacks? 🙂Please note, we are not a legal advice forum. Savills have now asked for evidence of the parking charge that was paid but my friend says there were two fines.
Should she evidence one or both?
I'm assuming they want to see that she's paid one which would show the one the DRA are chasing is likely to match her story that she didn't receive a letter for it.
