We received a parking fine for overstaying 30 mins.   My 3 children all share one car.  The car is registered to one of them, the child that the car was registered to was away at university so didn't open the letters.    We have now had 3 letters in total (all opened at the same time when they got back from Uni) Can we still do the blue appeal template?

Your child (the car's registered keeper) can, not you, but it will be rejected as out of time, but at least their process has been followed.  Thereafter, ignore anything other than a Letter Before Claim (probably from DCB Legal) or a real Court Claim from the Northampton CCBC. Highview have been issuing claims like confetti of late, but every one reported on the forum, where the motorist has followed all the court procedures, has resulted in a discontinuation. 

Please remember, this is your child's case, not yours. You cannot do it 'on behalf of', but you can do a lot of the research and drafting (if needed) to assist.

I have checked the retail site and all the shops close at 5pm so there was no loss of revenue to anyone as they say the parking was between 19.15 and 21.46.

Please see wording from appeal that I am going to send.  Does this sound ok?

You issued me with a parking ticket on xx.xx.xxxx but I believe it was unfairly issued. I decline your invitation to name the driver, which is not required of me as the keeper of the vehicle. I will not be paying your demand for payment for the following reason/reasons:

 

·         I was at university when this occurred and therefore could not have been the driver, nor do I know who the driver was.  The only letter received at my home address was dated 18/07/22. 

 

·         The charge is disproportionate and not commercially justifiable

The amount you have charged is not based upon any commercially justifiable loss to your company or the landowner.  I have checked the site’s website and the shops at this site close at 5pm.  The notice said the car was parked between 19.15 and 21.46.  There was no loss of revenue to the company or any of the shops on that site.

 

If you choose to pursue me please be aware that I will not enter into any correspondence and this will be the only letter you will receive from me until you answer the specific points raised in my letter.

That doesn't look anything like the blue template appeal that you were proposing to use in your opening post.

Yes, this will be in the name of the registered keeper.

The RK, not you, should just send the blue text template appeal unchanged.

Suggesting there is no loss doesn't mean anyone can park on anyone else's land whenever they feel like it.

Yes, but not the (sadly) really bad MSE one in the article about fighting parking tickets!  That isn't the one we advised you to use.

Could you tell me again where to find the one you recommend using.  I thought it was the one on the money saving expert site?
