Argos refuse refund because the box is opened

The product was not wanted and returned within about ten hours of purchase with receipt and they won't refund it because the packaging is "damaged" meaning its been opened.

    Was it delivered or collected from store?

    Did you buy online or merely reserve and collect (and pay in store)? Or did you order and pay in store?

    How much was it (more or less than £100) and how did you pay? (Credit card, debit card, Paypal etc.)

    If it was not wanted why was the box opened?  
  •  it was for GFs son Im guessing he tested it (games controller) and decided it wasn't what he expected it to be

    The actual wording of the relevant bit of their returns policy is:

       your item(s) needs to be:
       • Unused and with all parts
       • In its original packaging (with the tags if applicable)
       • In a resaleable condition
       • If the item or packaging has been handled excessively, we reserve the right to reduce the amount we refund you.
       • If you're returning a DVD, music or software product, it must be unused and in its original sealed packaging.

    So even if the packaging has been 'handled excessively' you should get some sort of refund.
    Perhaps the assistant your GF spoke to thought (wrongly) that it was a DVD or software product?

    Argos T&C states 'unused' and that is not the case here.  The OP states that the item was tested so there is no entitlement to a refund.
