Hoping someone can help,
i have received a County Court claim for a parking fine, i don’t remember receiving any warning letters etc before hand and i am currently working away from home for 3months so was only made aware of this letter yesterday when someone checked on my home address. Its dated 20th July and its states i only have 14 days to reply and today is day 10 so im panicking abit!
I believe this parking ticket was someone else that i leant my car to for the week but im not sure if that makes any difference.
Is it worth fighting? What do i do? Or should i just swallow it and pay?
Any advice is greatly appreciated! Thank you in advance

    Hello and welcome.

Unfortunately you have shown enough information on that Claim Form for anyone to be able to file a Defence on your behalf. In particular, you Claim number and your MCOL password are clearly visible.

It is also unfortunate that you have posted this on a weekend when I don't think MSE staff work at the weekend.
In the hope that someone might see it I have reported your post asking for that image to be deleted.

With a Claim Issue Date of 20th July, you have until Monday 8th August to file an Acknowledgment of Service but there is nothing to be gained by delaying it.
To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 22nd August 2022 to file your Defence.
That's over three weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service instructions.
Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

I see that this parking incident is alleged to have occurred at Rayleigh Station.

Often railway station car parks are covered by byelaws which means that only the driver can be held responsible for any parking infringement. It is therefore important that the driver's identity is not given away - all NCP know at the moment is the identity of the Registered Keeper.

Trick might be to make a few posts - once you reach a target of 5 or 10 (?) then you can edit - sweep back here and delete picture

Iv found the following on national rail website, so am assuming that regardless of who was driving il be held accountable? So is there any point in putting forward a defence still? Thanks

Does NCP know who the owner of the vehicle is?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

When considering @Umkomaas' question, have a look at the front page of your V5c.

But NCP don't issue byelaws penalties.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Please read again my post on 30 July at 3:09PM.

NCP have written to the Registered Keeper.

NCP do not know who the owner is.
