My wife is undecided and keeps asking me if she should pay the £100 (due tomorrow - 28 days after POPLA appeal failed) or go to court.

Are there any points I can pass on to help her decision please (other than the fact the operator shouldn't be able to get away with robbing people like this)?

She said she doesn't think she could be bothered with the hassle and stress of going to court.

    Thanks again
Don't pay. There is no dilemma here.

I go to court for people sometimes as a supportive lay rep and I'm just a non-legally trained middle aged woman.  Court is quite fun but highly UNLIKELY to happen with NCP.

Ignore them. Laugh at the 'debt demands' - hilarious drivel.

Come back if you get that hen's tooth and we will help her win; in any case it's highly unlikely it would get as far as a hearing.

  • Thanks Umkomaas and Coupon-mad. I'll pass that info on to my wife.

I may say I'll foot the bill if it goes to Court so at least she won't have to worry.

And it's 'only' £200ish (including the £100 PCN).  Just court fees, not some huge costs sum that people imagine.  And we win 99% of cases here or see them discontinued before hearings, once robustly defended.

  • Update:
I contacted my MP who contacted NCP.
NCP reduced the charge to £28 (original parking fee plus admin fee)
My wife paid to avoid further hassle.

Thanks again to Coupon-mad and Umkomaas.

Thanks for the final update, @saddlesore8

I think that's not too shabby - and in future, under the new statutory Code of Practice (2024) the proposal of £25 as the lowest end discount level for minor transgressions will certainly see far more paid.  I'm comfortable with that.

    And...

...please don't leave us yet!  Stick around.

We need you - as a genuine PPC victim of aggression, sharp practice and an 'extortion' attempt to threaten to add £70 - to respond robustly to the Public Consultation on the level of parking charges and banning of the false added DRA 'fee' that too many honest motorists currently fall victim to.

It will need consumer input (powerful voices) but change is afoot. It's taken about 5 years to get to this stage:
    https://forums.moneysavingexpert.com/discussion/6333036/breaking-news-government-has-announced-the-statutory-code-of-practice-and-enforcement-framework/p1

And then the industry threw victims' money at it and blocked and delayed it - explained here:

Please now Bookmark BOTH threads and set up email alerts on your posting profile, so that you get an email alert when we post there, as we will, once the Public Consultation opens later this year, once the new Ministers are fully appraised.

We need people like you and your driving family & friends to respond in high numbers! You have a personal story to tell about the culture of getting a DRA to add a pointless £70 for their own profit, to be let loose to intimidate people.
