Rights with Returning Misdescribed Items from Private Sellers?

For the first time last week, I turned to Vinted to buy a piece of second hand clothing. Unfortunately once the item arrived it turned out the item was of a different size to listed.

I was very busy & stressed when the item arrived, so didn't get round to taking photos/requesting a return until 3/4 days later. However, it turns out Vinted operate with a policy of a 2-day period to raise issue with orders.


What are my rights with requesting refund/return with this? I'm buying from a private seller, paying via Vinted, and being charged a "buyer protection" fee.


I contacted Vinted customer service, and despite much communication, they insisted their policy "clearly" states 2 days (I disagree on clear) and there is nothing they can do. After talking to the seller, they have agreed to accept return although I have to part-pay postage and won't be funded the "buyer protection" fee.


If I'd been buying of a company, I'd understand that Distance Sales regulations would allow 14 days to raise issue, and a further 14 days to return. What is the case for misdescribed/faulty items with private sellers online?


I don't really feel that it is moral I should have to shoulder any of the cost as the item was misdescribed. eBay has much more generous return policy and I will be thinking much before using Vinted again.

    Did you check  them out before buying?  Plenty unfavourable reviews on Trust Pilot.

    That's not really what my question was... I'm aware of their location however the Ts&Cs do state that the contract formed is enforceable in English courts (or additionally NI if residing in NI & Scotland if in Scotland). 

    With these marketplace websites the individual seller is usually going to be the main person you need to trust, so platform reviews aren't usually so relevant. I don't usually trust TrustPilot, it's notable that eBay has a lower rating than Vinted.

    Vinted operate 2 days to raise problems. If this is unacceptable then don't use them.

    To answer your question, there is no 14 day rule buying from private sellers.
