good morning all ,
Please could you give me advice on my faulty sofa, I Brought a sofa and chair from eyres of Worksop 26th nov 2022 from day one I have had faults first with right hand cushion with the leather which they promptly made good but I was more concerned with sinking on the left hand cushion ( top of sofa )after a string of excuses like because we only sat on the right hand side of sofa it was taking all the air out of left hand cushion) he finally came to fix this on the 23may and put new cushions in on both sides ( which wasn’t really needed they would not fit at all to small so he did no more than take out lots of filling and stuffed it anywhere he could to fill the cushions out and make them fit ( he stuffed the filling in between the leathers on the interior cushions not inside the cushion bags themselves so therefore as soon as he went they just collapsed in on themselves and it was even worse the next day, I emailed him the next day and sent photos he then sorted out another firm called Scott& sons to come out, he did exactly the same thing only stuffed more filling in overnight it sank again and he’s put that much filling in the right hand side it’s full of lumps bumps you get back ache, he’s now arranging to have some more new cushions put in but won’t give me a time frame it’s now been roughly 6-8 weeks since I have heard anything from them, I already have a illness but now I have another more serious which I keep having to go to hospital for treatment I am struggling to fight this and fight my illness, the sofa wasn’t cheap £1,800 and £1,800 for the chair where do I go from here please any helpful advice would be very much appreciated thank you all for your time and effort in this matter oddies x x x

"26th nov 2022" ? Do you mean 26th Nov 2021? Or earlier than that? If it was last year, when did you first report the issue? If the sofa was bought November last year AND you reported the issue before 26th May this year - which it sounds like you did -that should help.
Assuming the issue was reported within 6 months, then the default position should be that faults are assumed to be manufacturing defects unless shown otherwise. The retailer is then allowed 1 attempt to fix the issue - which they've had. Your position now is that you can ask the retailer to replace or refund. If they refund, they can reduce the amount based on the usage you've had so far. Another alternative would be to accept a reduction in price (i.e. you get a partial refund, but get to keep the sofa) - however that wouldn't fix the issue with the cushions. Or you could just accept their further attempts to fix the issue.

Thank you Ergates, sorry I meant nov2021 and yes the issue was reported with the 6 months the manufacturer is claiming it’s not there fault ( they have been out once and weighed the cushions apparently they were the correct weight. So they say it’s retailers fault. I have asked for a refund but they just saying they will correct the fault and to trust them ( which I no longer do ) I would prefer they fix the problem I just want what I paid for within reason at the moment it’s not really fit for purpose as you get back ache from over stuffing and yes I could take some out but that would result in the cushion to deflate again, I am assuming the filling will move overtime so the issue will be even worseI just don’t know what I should do anymore what about the consumer arbitration which I have heard of ?2016 Jan Wins: 9ct white Gold Diamond Necklace £530.00, Doro Easy phone.
