Lost Diamond/Insurance/S75

Hi All,
My partners Diamond has fallen out of her engagement ring and is nowhere to be seen.
The ring was not insured through any special ring insurer.
We have Hastings Essential Home Insurance which from what I gather has a valuable item cover for Loss at £1500. I have submitted a claim in hope its honoured.
If not, I've been reading about Section 75 using a credit card - This ring was purchased on a virgin mastercard back in 2020. The card is now paid off essentially but still have the account. Does anybody know where I may stand with regards to S75 and the ring essentially been damaged/faulty from one of the clasps breaking causing the diamond to seperate itself from the ring and be nowhere to be found?
I did call the shop that the ring was purchased from, he did say come and see us and I'll see what we can do - I have no hope with this though as any diamonds over 0.10 are not covered.
Thanks

S75 covers various things but you'll normally be expected to go through the complaints process first with the shop and then get proof (via an assessment by an independent third party) that the product was sold faulty (you can claim this cost as part of s75). 2 years from sale is a decent amount of time though a ring should be expected to last a long time of course, whether the card issuer rejects it is unknown, depends a lot on what you are trying to claim for e.g. just a replacement stone which could be made in a lab fairly cheaply or if you are wanting to get a mined diamond. They might also argue that the ring being bought by you for her means there is no case but that would be arguable over the "joint benefit" side of things

If you have damaged it and have accidental damage cover on your home insurance and the damage was caused in an area covered (ie in the house if you dont have PP cover) then the insurer will cover it assuming the value is within the policy limit
If its faulty then insurance wont cover it however that opens your path to a S75 claim which wouldn't be available for accidental damage. To make a claim you'd need an experts report that confirms the ring was faulty.Deleted_User said:S75 covers various things but you'll normally be expected to go through the complaints process first with the shop0 -

Can you prove that it was faulty? How many clasps (actually normally called claws) were holding the diamond? If there were only 4 then there is always the risk that one breaking means the diamond can slip out. Better to have a design that has 6 claws, so you would need 2 adjacent claws to break to risk losing the diamond. Or even some other setting type.I'm a Forum Ambassador on the housing, mortgages, student & coronavirus Boards, money saving boards.
