    I am failing to understand how 'Due to most of the surrounding public highway being double yellow lined, no nearby alternative to the car parking facilities was available for the Defendant to use' is of any real relevance or helps your defence to the claim.

    Because there was nowhere to park apart from that carpark hence why I parked in there in the first place. It was a Sunday evening all businesses closed so it was empty so nobody was making any financial loss with my car being parked in the carpark

    That's not a valid reason to use a private car park.

    Can you tell us more about why the driver parked there, did they have business or were visiting someone on site, or shopping there?

    This is a bit vague, I would explain why the signage displayed is "insufficient" why was you not aware? just a brief explanation.


     3. It is admitted that the Defendant did use the car parking facilities however the Defendant was not made aware of any terms and conditions due to insufficient signage at the car parking facilities. Due to most of the surrounding public highway being double yellow lined, no nearby alternative to the car parking facilities was available for the Defendant to use.

    I was parked there as I was having a family meal at a nearby business.

    But why use a private car park that's reserved (presumably) for another business or residents? This is what the Judge will ask.  There is no defence in saying there were double yellows on street so you drove into a random car park, which is how it all sounds I'm afraid.

    Was the signage terrible?  Dark and unlit?  You had a good look but had no idea this was a managed car park with a contract?  Can you show us a Google Streetview link please?

    Ok, so it's Bramley shopping centre which I can see does have several signs 'customer parking only'.

    What's the allegation on the PCN? Leaving the site? The restaurant wasn't on site?

    Or was it pay and display, or were all the shops shut as it was late?

    Apparently I overstayed by 30 minutes. There's no pay and display. The restaurant was located nearby but not on the site itself.

    It was a Sunday evening.

    If it was dark (Winter. not a light summer evening?) then obviously add in that any signs were not lit and it appeared (or you were aware already from using it before?) to be a free car park for local shops and restaurants with nothing clear and obvious about any limited time restriction.
