MCOL timescale?

2.5 years ago, after a Claim Form from CCBC, I creased an MCOL account and created the AOS etc.  This has been dormant for 2.5 years.  Is there any kind of timeout for such things?  I have moved addresses since then too, should I add this somewhere in MCOL?

  • Yes, defence was received.  No, I have not checked my credit records.  I have had no other communication from the courts on the matter.

    Email the CCBC to ask if the claim is indefinitely stayed and to erase your old address because you have moved to (new address).

    Add that it is wholly unacceptable that the public should see parking claims kept indefinitely in limbo and have to somehow know to tell the court every time they move address - seemingly being tied to the onerous expectation of doing this forever - just in case the vexatious parking firm claimant decides to lift the stay, years later.  Countless defendant victims of parking firms will get CCJs as a result, because the UK population is transient.

    Ask that this email be placed with the case file (and the old address erased) and that, in the event of the claimant ever lifting the Stay, in the interests of justice the claimant be required to confirm to the court's satisfaction that it has re-checked the address for service before the case is resurrected. In the alternative, you ask that a Judge now reviews and strikes this dead claim out.
