UKCPM / Gladstones county court claim

Hi all,

Huge thanks right at the start for everyone who contributes, this forum is such a great resource. 

My wife received a parking fine through the post in July 2019 for parking in the car park at the back of her hairdressers. She had followed direction from the manager to do so and so contested the ticket through the UKCPM appeals process. She lost but did not pay and has been getting letters from Gladstones ever since. This has now developed into a County Court claim which she received yesterday (not sure if we ever received an LBC).

I'm in the process of putting together the defence but wanted to check at this stage if I've missed the window to complain to the hairdresser, send an SAR and send an email to Gladstones about putting the case on hold?

    Did your wife receive it a registered keeper?  If so, she has to do the AoS and defence in her name.  You can, of course help but she has to sign it.  Have you read the NEWBIE sticky which outlines the whole court process?  Have you had any response to the SAR?  When was it submitted?  What is the date of issue of the N1 claim form?

    Thanks for the reply. All being done in my wife's name as driver and registered keeper - I'm just helping out with the admin.

    I have read the newbie sticky, very useful. We haven't submitted an SAR yet as I'm unclear if we can still submit one now that we have received the N1 claim form?

    Send the SAR to the parking company. Even if it does not arrive before you have to submit a defence, it will still be helpful at witness statement time, knowing exactly what data they hold.
    The pen is mightier than the sword ..... and I have many pens.

    Issue date is 18 July 2022, haven't responded yet.

    But no email to Gladstones asking for the case to go 'on hold', of course! This is a live claim so that's not possible.

    Make sure your wife doesn't do the AOS before day 5. See NEWBIES thread but don't do it early.

    You understand you then (after AOS) would have an extended 2 weeks extra to do the defence? You need to stick around and read other defence/claim threads and not wait for the SAR reply.

    OK - so I can do the AOS up to 14+5 days after the issue date then another 2 weeks to do the defence?

    I won't wait for the SAR - currently researching similar situations to put together the defence.
