We're hoping we can do the lower deposit option, but it will be up to the seller to decide and we're not sure how the conveyancer has communicated the issue with them.
We're viewing the house again this week with the vendor there, so may raise it directly so they don't think that we're messing them around.
How did you get on? Lower deposit option worked for us! we did it on our £500 reservation fee! Worked a dream.

You just need a good solicitor on your side who understands the constraint. After we explained our situation to our  solicitor she was quick to understand and fight our corner with the developer even more fiercely!
