TERMS AND CONDITIONS for “Magic On The Beach Online Competition” (the “Competition”).

 

 

 

These terms and conditions (the “Specific Terms”) for the Competition should be read alongside  our general competition terms and conditions at: http://www.bauerlegal.co.uk/radio-competition-terms.html (the “General Terms”) which will also apply to this Competition. Where there is any conflict between these Specific Terms and the General Terms, the Specific Terms shall prevail. 

 

 

 

 

 

 

 

1.Entry ROUTES and Costs	Online Competition:     Entries are restricted to one entry per person.   Entry to the Competition is available via the following routes:   Online at www.planetradio.co.uk/Magic/     Online entry is free of charge.
2.COMPETITION MECHANIC AND HOW TO WIN	To go into a draw to win a holiday to Spain, the entrant must write down a ‘holiday ritual’ and submit a song request. This will automatically put them into an automatic draw to win the holiday. From the selection of entries Magic production will pick out some of their favourites to read out on air in the Magic Breakfast show each Friday for the duration of the competition period. They will also select one entrant each week to play their song.   PLEASE NOTE. IF YOU HEAR YOUR HOLIDAY RITUAL READ OUT ON AIR AND/OR YOUR SONG PLAYED THIS DOES NOT MEAN YOU WIN A HOLIDAY, IT IS JUST A PART OF THE COMPETITION MECHANIC. YOU ARE STILL HOWEVER IN THE POOL WITH THE REST OF THE ENTRANTS FOR THE ONE HOLIDAY THAT WILL BE AWAREDED AT THE END OF THE COMPETITION PERIOD.   PLEASE NOTE, WHEN YOU ENTER THE COMPETITION, YOU ARE AGREEING TO BE POSTED ACROSS MAGIC’S SOCIAL MEDIA PLATFORMS AND ON-AIR ON MAGIC RADIO.   The prize winner will be selected by electronic random draw, from a pool of entrants who enter the competition for the duration the campaign burst is live from the 15th of July 2022 – 14th of August 2022.
3. ENTRY PERIOD	Entries must be submitted during the following entry period:   From Friday 15th July at 15:00 (the “Start Time”) to Sunday 14th August at 23:59 (“End Time”).   Entries received before the Start Time or after the End Time will be invalid.
4. ENTRY RESTRICTIONS	Open to UK residents aged [18] years or over on date of entry. Our employees (and their family members) or employees of any company involved in the Competition, including any Prize Provider, are not permitted to enter. We reserve the right to disqualify any entrant or winner who does not comply with any of the eligibility criteria and/or is in breach of these Terms. We reserve the right to repeat the competition mechanic or any stage of it in order to draw a winner that fulfils all of the eligibility criteria and is in compliance with these Terms. PLEASE NOTE. IF YOU HEAR YOUR HOLIDAY RITUAL READ OUT ON AIR AND/OR YOUR SONG PLAYED THIS DOES NOT MEAN YOU WIN A HOLIDAY, IT IS JUST A PART OF THE COMPETITION MECHANIC. Anyone who has won a Bauer competition to the value of £500 or more within the past 6 months on any Bauer Radio Brand, will not be eligible to take part in this competition nor will anymore else at their address. If by any chance they get through to the phone lines – any prize they have been successful with will not be awarded. 5. THE PRIZE	Online Competition:   1 x Winner of the following Magic x On the Beach (the “Prize”):   4* All-Inclusive 10 night holiday to Spain 1 x free Spanish course with DuoLingo. Please note due to the current Covid-19 situation, delivery times may be extended and may over-run the 28day delivery period as noted in our General Terms and Conditions. There may also be delays to a member of staff contacting winners once the competition has ended.   Prizes are non-transferable, non-refundable and no cash alternative will be offered.   Additional Terms and Conditions On the Beach Limited ("OTB") hereby agrees to supply the Prize (as defined below) to HBVB, a company incorporated in England & Wales (company no. 08453545) whose registered office is Media House, Lynchwood, Peterborough Business Park, Peterborough, PE2 6EA to be used in connection with the ‘Monday Magic’ giveaway on 18/07/2022 as part of the OTB sponsorship of Magic Breakfast Show. HBVB accepts that the Prize is supplied subject to the Prize conditions set out below and HBVB shall ensure that the recipient of the Prize (the "Winner") is referred to such Prize conditions and made aware that by accepting the Prize, the Winner will be deemed to have accepted and will be bound by the Prize conditions. PRIZE CONDITIONS The prize will consist of a holiday voucher worth £3,000 which is redeemable against a 10 night all inclusive package holiday booking (that comprises of a flight and hotel) to Spain made with www.onthebeach.co.uk (the "Prize"). The Prize can only be redeemed against a holiday which is advertised on OTB’s website (www.onthebeach.co.uk) comprising of a flight and 4* hotel for a 10 night duration, of an all inclusive board type to Spain (including the Canary Islands and Balearic Islands). The Prize cannot be redeemed against flight only or hotel only bookings. The Prize must be redeemed by booking a holiday comprising the above before 30/09/2023. No extension is possible. Any changes made after the booking has been processed are subject to amendment fees. The Prize has a maximum value of £3,000 only. Any cost above this amount is the responsibility of the recipient of the Prize (the "Winner") and must be paid in full at the time of booking. No alternative payment plan or method shall be available to a Winner in any circumstance. The Prize does not include travel insurance, or any other items or expense not specifically stated within the Prize description. All such costs and expenses will be the responsibility of the relevant Winner and members of their travelling party. The Winner and their travelling party are responsible for charges that apply for any food, beverages or services outside of the all-inclusive plan.   The Winner and their travelling party are responsible for ensuring they (i) hold a valid passport and any necessary visa to travel, (ii) hold all adequate travel insurance policies, and (iii) comply with any other terms and conditions applicable to the Prize. Once OTB has been informed of the Winner by the promoter of the competition, OTB will contact the Winner to facilitate the Prize. The Prize cannot be redeemed online. It may only be redeemed upon a telephone booking. The appropriate prize value will be deducted from the overall booking cost and the remaining amount must be paid in full at the time of booking by the Winner. Any booking made to redeem the Prize is also subject to OTB’s separate terms of business, and the terms and conditions of the suppliers of the flights and accommodation. Any fees or costs associated with or incidental to the acceptance or use of a Prize (other than delivery of the same in accordance with these terms) will be the responsibility of the Winner. The Prize is subject to availability and OTB reserves the right to replace the Prize with an alternative prize of equal or higher value if circumstances beyond OTB’s control make it necessary to do so. The Prize is non-exchangeable, non-transferable and has no cash value. No cash equivalent will be given. 1. DATA PROTECTION. Names, email addresses, and /or telephone numbers (which, for all SMS competitions, will be shared with our SMS provider) will be collected and used to process entries. Winner’s details may be given to a Prize Provider to arrange delivery of the prize.  Your details may remain stored after the End Date but will not be used for marketing unless you have ticked an opt-in box on entry. For SMS entries you automatically consent to receive marketing. You may opt out at any time by texting the word STOP to the relevant text shortcode number. If you have opted in to receive marketing communications, then your details will be used in accordance with the information given when you ticked the opt-in box and gave your consent. 1. INTELLECTUAL PROPERTY AND CONSENTS. By entering this Competition, you are consenting to our use of your entry both to publicise this Competition, our radio station or any other radio station which we own or control. This means that we may use all names, images, descriptions, photographs video footage, and other information, which you have submitted on entry, in any media, without paying you any remuneration therefore and without any time restriction. You also agree that we may film, record or photograph you in connection with the competition and /or the Prize if applicable. We will own these films, recordings or photographs and we may use them publicly, including on the internet, for our radio broadcasts and/or for any promotional purposes. You will also have waived any moral rights or right to payment that you may have had.

 

 

 

1. MISCELLANEOUS.

 

 

 

• Entries which do not comply with these Terms or the General Competition Terms and Conditions will not be accepted and any entries may be disqualified if we have any reason to suspect that there is a breach of, or non-compliance with, these Terms.
• Where a competition mechanic involves the answering of questions, the correct answers to questions must match our answers to win (or be sufficiently close in our sole reasonable opinion) to be acceptable. In the event of any dispute about any answers given and whether they are correct, we reserve the right to amend what we deem a correct answer, however we are not obliged to, and our decision in either case is final and no correspondence will be entered into.
• We are not responsible if you fail to get through when you call / text to enter, or if you lose signal during a call.
• You are responsible for all costs of entry and where necessary, obtaining the bill payer’s permission. Please refer to your tariff with your network provider for information about charges you may incur for entry into our competitions via any SMS or phone call entry route.
• We accept no liability for network, technical or signal errors, issues or failures experienced by entrants when entering the competition or at any stage during the mechanic of the competition.
• Whilst on-air, you must not make any inappropriate, profane, indecent, harmful or offensive statements. If you do so we reserve the right to take you off-air immediately and disqualify you from the competition. You may be also disqualified from the competition at any time if you are incomprehensible, inaudible or if you appear to be driving, intoxicated or likely to offend listeners. Any prize already won may be withdrawn and re-awarded to another entrant.
• As far as it is lawful to do so we exclude our liability for any losses suffered in connection with the Competition or any element of the Prize.

 

 

 

We may cancel, end or suspend the Competition where we are required to do so in circumstances outside our control. We reserve the right to amend these Terms at any stage during the Competition if such amendment is necessary to facilitate the administration of the Competition.
