Afternoon All,

It was so unfortunately to receive email today that home insurance has been cancelled, i made a claim around 1st April 2022 due to escape of water in my house and first the claim was approved after series of calls to HastingsDirect. 
Please find the below messages to enable know the next step please, am really devastated. 

(1ST LETTER FROM THE ADJUSTER BELOW:

Hi (Removed by Forum Team), thank you for this.

I am happy to offer a cash settlement based on your estimate for the strip out and repairs to your property.

Estimate amount - £5950
Policy Excess - £750
Total Cash settlement - £9250

Please confirm acceptance of the above and provide bank details for prompt payment usually within 10 working days.

Following our settlement of your claim, we do have an obligation to advise you of the Construction Design Management (CDM) Regulations that are applicable to all Construction Work, including repairs.)



(2ND LETTER FROM THE ADJUSTER BELOW:


(Hi Michael, 

I noticed a typo in my settlement amount so just to confirm the cash settlement will be £5250 not £9250.

 

To make you aware, insurers have asked me to place our file on hold for the time being whilst some checks are being carried out. Therefore I am unable to raise payment until authorised to do so by insurers.

LETTER FROM THE INSURANCE TODAY BELOW:

We refer to your policy and your Escape of Water claim submitted.

Your home insurance has been voided from 27th January 2021. Your Consumer Credit Agreement has also been terminated. This means we'll treat the policy as if it never existed.



Following our claim enquiries, it has come to our attention that you have incurred County Court Judgments which are linked to your address.
Certain underwriting factors are taken into consideration when deciding whether to accept insurance cover and these factors include County Court Judgments. If the County Court Judgments do not meet our acceptance criteria, then Integra will not offer a quotation for insurance cover.

You originally obtained your insurance cover through Hastings Direct via the aggregator site Confused.com, to which you were asked the following:
• Have you or anyone living in the property been declared bankrupt or had a County Court Judgement (CCJ) or Individual Voluntary Arrangement (IVA)
• (If a CCJ) Has the CCJ been paid?

As you confirmed that you and anyone usually living with you had not incurred any County Court Judgments cover
was accepted through Integra and a Statement of Insurance was issued. The Statement of Insurance confirmed the following:

• Ever had a County Court Judgement – No

Under the Consumer Insurance (Disclosure and Representations) Act 2012, you have a duty to take reasonable care to answer all questions fully and accurately. If you volunteer information over and above that requested, you must do so honestly and carefully. If you don't answer all questions fully and accurately, it could invalidate your insurance cover and result in all, or part of a claim not being paid.
When your policy fell due for renewal in January 2022, it was automatically renewed based on the information heldonyouandyouwereissuedwithpolicydocumentation. Thedocumentationadvisedoftheconsequences of providing incorrect details and also reiterated that we needed to be made aware if you have received any County Court Judgments.
When considering potential misrepresentations, we always ask our policyholders to explain why the relevant facts were not represented correctly. You have confirmed the reason the County Court Judgments were not disclosed was due to the fact that:

• You were not aware of the County Court Judgments against you.
• You lost both your parents on the day you were purchasing your home insurance policy with Hastings
Direct.
• You do not remember been asked a question in relation to County Court Judgments.
Please be assured that we have taken your explanation for the misrepresentation into consideration, however, we also have to take into account the fact that had you disclosed when obtaining your insurance cover at the inception of the above policy that you had incurred a CCJ prior to our inception you would have been made aware that the risk was unacceptable to us. When the policy fell due for renewal had you confirmed that another CCJ had been incurred we would not have offered any renewal terms.
Under the circumstances we have no alternative but to treat your policy as void with effect from inception and a full refund of premiums will be returned to you by Hastings Insurance.
As your policy has been voided with effect from 27 January 2021, we are unable to be of any financial assistance in respect of the current claim.
We appreciate that you will be disappointed by this decision but hope that you understand the reasons behind it.
