Parking ticket from 2017

Haven't made a post yet (or at least can't find one if I did - I did search for one...)...

Apparently the driver of the vehicle for which I am RK overstayed a three hour free shopping car park.

The agent is Highview Parking. They've now appointed sols.

I don't recall receiving any documentation from them (there was a house move at the time but nevertheless, details were updated with DVLA etc speedily within relevant time periods).

They issued a claim. I filed my AoS and defence denying the claim.

The court wrote to all parties listing it for a hearing and requesting the evidence be provided by the claimant or it would be struck out. The deadline has not arrived yet.

Received an Offer to Settle (£205 instead of their claim of the balance of around £300).

I've drafted an email response (not sent yet):-

​Dear Sirs

Without Prejudice, save as to costs 

I am firmly of the view that my case will be successful at any hearing. I note that you are yet to comply with the directions of the county court judge.

As a result of your continued non-compliance with both general court procedure and specific judicial direction, I am at a complete loss as to the nature of your claim as no evidence has been received in support of your claim.

Notwithstanding the above, in the spirit of disposing of this matter swiftly and conveniently, and in compliance with the CPR, I'm willing to offer of settlement in the sum of £5 in full and final settlement of your client's claim. This offer is made entirely on a without prejudice basis and with no acceptance of liability.

Please note this offer will remain open for a period of 21 days from the date of this letter after which time the offer will be withdrawn and any court action will be defended in the normal way. In the event of you failing to achieve a judgment in excess of the sum offered in this letter an application will be made for an order that your client pay the defendant's wasted costs of the action in full.

I respectfully remind you of your client's duty to mitigate its losses and trust that you will advise your client accordingly.

I look forward to hearing from you within the timescale stipulated in this letter.

Thoughts? Best approach here? Or just ignore and wait for them to not comply and for it to be struck out?

    I already did search (as mentioned) and cannot find one where I posted about this, so the instant thread here will be the one where I'll ask this question and hopefully someone can help :-)

    I wouldn't offer them anything. If you are reading other Highview/DCB Legal threads (I take it that DCB Legal are the appointed sols), you will find that once the 'offer to settle' letter is received, ignoring it is followed shortly by a discontinuation.  

    Just stay with the process and see if their pattern repeats itself in your case.
