Good afternoon, I am looking for anyone who is in the same boat as our family, we booked a new year holiday for 2021/22 with Teletext holiday, only for them to then go into administration, we where informed our booking had taken over by a company call Truly Travel (London Based) . our final payment was due and we paid the 6K outstanding balance. we then found out that Wizz Air had cancelled the flight we where due to go on as part of the package and more importantly this was cancelled two days before our balance was due, had we known we would not have paid our balance. we contacted Truly Travel to say the flight had been cancelled and they informed us that our holiday was now cancelled and we where due a full refund. 9 months down the line still no refund but a load of reasons why they are still looking into this, we then received a mail saying we can have a refund less £1600 cancellation charge, WHAT for a holiday we did not cancel no way, so back to emails the latest being we are now in dispute with TT because we wont pay the cancellation charge. they said six weeks ago we would contact us in 2 to 4 weeks, nothing at all and they still have our 6K, We contacted ATOL who basically fobbed us off saying while they are looking at it there is nothing they can do, we contacted the credit card company we booked the holiday on same reply nothing we can do whilst they are communicating with you. This is not only unfair, its daylight robbery, no one will answer a phone, they in my opinion have no intentions of paying up. Does anyone know if there is a legal route we can go down to recover our money.

1st question have you ever heard of paragraphs?Get back on to your credit card company as this is clearly a Sect 75 claim as Truly Travel are in breach of contract as they have not supplied you with what you paid for.Live each day like its your last because one day you'll be right0

I am sorry to hear of your tale of woe, alas you are far from the only customer in this situation. Truly Travel were supposed to ensure funds were held in a trust account organised by the Travel Trust Association but judging by the number of issues, the money isn't there to pay out. As suggested go back to your credit card company and ask to make a section 75 claim as TTA are not responding and the company you paid has ceased to trade. If they refuse, advise you will be contacting the Financial Ombudsman scheme.
If you actually used a debit card then I suspect payment was years ago and the time limit for making a claim has passed, but if you were due to travel this year within the last 4 months then I would argue the 120-day limit has not passed.
If nothing seems to be working please contact your local MP, a number of them have been pressuring the civil servants in the Business Department to get things moving and that may help.0
