Pothole damage!

I am currently going through something similar, where the LA stated yes the road is there responsibility, but because I hadn't reported the pothole before it damaged my tyre rim (had to replace rim and tyre) MOT and service had been done a month beforehand so it's not that.
I live near the road and can still see 10+ potholes down the road, but the LA only fill in potholes that cause people damage.
However I'm fully aware that those who live in affluent areas (same LA) have their road resurfaced (even though they had no potholes) just seems silly that this happened due to my postcode, as they maintain road on the affluent side.
I've gone to small claims though, they missed the reply date initially but court gave them leniency and now lawyer is emailing stating that I need to stop the case as it's gong to cost me. Even got a witness who apparently drives down the road with a ruler and states he reports potholes regulary on his journey. Both are LA employees.
My LA have enough money, they've received more money then the rest of the shire combined.
Small claims court next month will see what happens, I'm hoping that the judge is fair.0
