Parking Ticket But Not Clamped
HELLO EVERYBODY, CAN ANYBODY HELP.
MY WIFE HAS JUST GOT A PARKING TICKET FROM A PRIVATE COMPANY WHO NORMALLY CLAMP CARS, THEY CHARGE £70 TO REMOVE A CLAMP.
I AM NOT SURE IF THE COMPANY IS PUSHING ITS LUCK IN JUST ISSUING A TICKET FOR £70 AND NOT CLAMPING THE CAR.
CAN PRIVATE COMPANIES CHARGE USING TICKETS AND NOT CLAMPS?
BASICALLY DO I HAVE TO PAY THIS CHARGE?(I HOPE NOT)

What the hell do I know?? ;-) but here goes. I would have thought though that £70 was to cover towing or clamp removal and storage of the vehicle. Maybe they were waiting for the tow truck to come and get it, or ran out of clamps? So possilbly lower fine?
I would also check the paper work is in order, look for errors!

This sort of thing makes my blood boil. Keep us posted and see if there is a way out.

I once received a ticket and wanted to appeal. When I called up the locals they told me that I can only appeal in the court. So by default I lose the 14 days period for 50% charge and if my appeal is not successful, I pay The original £80 charge, £25 for failing to pay within 28 days & £50 for court fees. F**kers!! I paid £40 against my will.

I assume that this was a "parking ticket" for parking on private land and not a penalty charge notice that would be issued by or on behalf of a local authority (council)?If so what they are effectively doing is charging you for damage to the land by virtue of tresspass. Normally they enforce the collection of these damages by imobilising the vehicle, normally by clamping or by towing it to a compound. In either case the vehicle is then held to ransom pending the damageds payment being made. The amount of the damages is not regulated by law. However, to obtain the use of your vehicle you invariably have to pay up the amount demanded. Some small concession was obtained a few years back where it was rewquired that the use of signs be made to warn drivers that parking was not permitted and that a charge would be incurred and/or clamping and/or removal of the vehicle could occur.
Whislt you are guilty of tresspass inevitably the amounts demanded are out of proportion to any damage suffered or losses incurred due to the parking offence. As such I would not pay the amount demanded and wait and see if they try to persue the matter further. I would be very surprised if they took you to court to recover what they see as a debt. Even if they did, they would then have to justify the amount being claimed, which in my opinion they would have great difficulty doing. And, in any case, I would just plead ignorance and say there was nothing on my car (“the parking ticket”) in any case.
So my advice is forget it and see what happens. And suggest to your wife that she stays away from there in future as they will be looking out for you the next time if you get one over them this time. Good luck.
BTW, what exactly does the ticket say and who issued it? Do they have an address and landline phone number?0
