Prize and Entry Information.

This contest, sponsored by TourRadar, and Intrepid, allows travellers to enter for a chance to win two seats on one of the trips shown after entering the contest from Intrepid. To enter this contest, entrants must enter a valid email address into the field provided on https://www.tourradar.com/travel/adventures-in-the-usa and choose their preferred tour. The contest prize does not include any additional flights or means of transportation other than what is provided by the tour operator, flight partner and what is mentioned in the trip notes. Please note that this prize is non-transferable, has no redeemable cash value and is open to all travellers from 18 to 90 years old. NO PURCHASE OR PAYMENT IS NECESSARY IN ORDER TO ENTER. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED. Odds of winning a prize depend on a number of factors including the number of eligible entries received during the Contest Period.

Contest Period and Winner Selection.

The contest starts on 09H00 CET 01.07.2022 and ends on 16H00 CET 31.07.2022. TourRadar will select one (1) entry for the Prize in a random drawing from among all valid entries received during the Contest Period. The winner will be contacted by one of our agents and the announcement of the winner will be made 7 days after the contest ends. TourRadar’s decisions as to the administration and operation of the Contest and the selection of the potential winner are final and binding in all matters related to the Contest. Good luck! THE ELIGIBILITY OF ALL POTENTIAL CONTEST WINNER IS SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST. Winner is responsible for all taxes associated with prize receipt and/or use.

Entry Conditions and Release.

By entering, each participant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Sponsor, which are binding and final in all matters relating to this Contest; (b) release and hold harmless Sponsor, TourRadar, Inc., and its subsidiaries, and affiliated companies, participating sponsors, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Contest, and each of their respective past and present officers, directors, employees, agents and representatives (collectively, the

“Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of

or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Contest, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable

attorneys’ fees) arising out of or relating to an entrant's participation in the Contest and/or entrant’s acceptance, use, non-use or misuse of the prize.

Additional Costs and Requirements. Additional spending money, additional meals, taxes, insurance, passports, visas, vaccinations, transport to and from departure point, additional transfers, items of a personal nature, in-room charges, and all other ancillary costs are not included and are the winner’s responsibility unless otherwise stated. Additional airfares are not included in the prize and are the responsibility of the winner. It is the winner’s responsibility (and their invitee’s) to arrange their transport to meet with the flight and the tour at the departure destination. It is compulsory that the winners and their invitees take out comprehensive travel insurance before they travel. Local Payment not included within the prize, if you choose a no local payment promotion, subject to conditions. Cannot be used for a tour already booked, paid in full or deposit but it can be upgraded to a longer tour within the same destination by paying the difference of the chosen departure dates based on non-discounted brochure rates. TourRadar and the participating partners have the right to refuse passengers without the required insurance cover. The prize is subject to availability and conditions. The final travel date must be confirmed to TourRadar at least 45 days prior to the intended departure otherwise the prize will no longer be valid and will be forfeited. Extension cannot be issued.

Taxes For US Residents. All state, local, federal and or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner. All those who win a prize or prizes valued $600 or more in any given year will be issued an IRS Form 1099 to report their winnings. The actual retail value of the prize will be reported on the IRS Form 1099.

Publicity. Contest entrants agree that by providing their email address they give permission to TourRadar online newsletter lists and receive future correspondence via email. Except where prohibited by law, participation in the Contest constitutes winner’s consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration. Entrants may remove their name from the list at any time by clicking 'unsubscribe'.

State and Country Exceptions. The contest is not open to residents of India, Belgium, Sweden, Quebec.

Referral Link. Upon entering the contest, a unique referral link is provided by TourRadar to the contest entrants. The contest entrants may share this link with their friends to increase their chances of winning with every referred friend that enters the contest themselves. Referral links should only be used for personal, non-commercial purposes, and should never be distributed where there is no reasonable belief that all or most of the recipients are personal friends. TourRadar reserves the right to deny any additional entries believed to be gained through fraudulent means.

Travel Terms.

The prize is for 2 spots on the winner’s choice of 4 Intrepid Travel Domestic USA Tours (listed above). Airfare is not included by Intrepid Travel.
Prize winner must be age 18+.
Formal trip booking must be completed by December 15, 2022 for travel departing by December 15, 2023.
Does not include spending money, meals, travel taxes, trip kitties, and any costs related to travel insurance, passports, visas, vaccinations, transfers and all other ancillary costs (as well as the costs of obtaining any of these). All such costs and matters are the responsibility of the Prize winner.
The prize must be accepted as awarded, there are no substitutions.
The prize is non-transferable, has no cash value and cannot be redeemed for cash.
Once booked, the Intrepid Travel booking will be subject to the Terms and Conditions of Intrepid Travel.
Prize winners are solely responsible for all costs not expressly described herein including, without limitation, applicable taxes, fuel/currency surcharges, airport transfer transportation fees not included in trip itinerary, meals and alcoholic beverages, other than described herein, room service, gratuities, merchandise, telephone calls, medical and travel insurance together with any required travel documentation, and all personal expenses of any kind or nature, together with any applicable overnight layover.
The Prize winners are also solely responsible for all costs incurred to and from the departure point as the Prize originates and terminates there.
It is the sole responsibility of the Prize winners to obtain all necessary travel documentation including passports and visas, as applicable and to comply with any customs and immigration requirements.
The Prize winners must obtain medical insurance prior to departure and it is recommended that Prize winners obtain sufficient personal insurance prior to departure.
It is recommended that the Prize winners consult a physician prior to travel to determine the advisability of immunizations and inoculations that may be appropriate.
There must be 4 confirmed passengers on a departure before a Prize winner can be booked.
Black-out dates: December 15, 2022 – January 15, 2023. Tour cannot depart within these dates.

General Conditions.

Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

If, for any reason, in the sole opinion of Sponsor, this Contest or any supplier of the travel product is not capable of running as planned by reason of an Act of God, disease, epidemic, pandemic, quarantine, acts of government, infection by computer virus, worms, bugs, tampering, hacking, unauthorized intervention, fraud, technical failures, system overload or any other causes, whether discovered or suspected by Sponsor, which, in the sole opinion of the Sponsor, does or could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend this Contest, and/or provide alternative means of entry or any other changes to these contest rules that Sponsor deems appropriate under the circumstances. In the event of termination, suspension or modification of this contest, a notice will be posted online.

Disputes.

Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, other than those concerning the administration of the Contest or the determination of the winner, shall be resolved individually, without resort to any form of class action; disputes shall be governed by and construed in accordance with the laws of Austria. Any claims shall be brought in a court of competent jurisdiction located in Austria. Sponsor shall not in any case be liable for other than compensatory damages, and your entry in the Contest means that you agree to these conditions and expressly waive any right to punitive damages. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
