Electrical Item died after 11 months, do I have any consumer rights?

Hi all,

The answer here might be a resounding no, however I'm not sure if the sale of goods act would cover it?..... I purchased a weed burner 11 months ago (august 21) - when using it today it just "popped" and died.  It was originally purchased on amazon.https://www.amazon.co.uk/gp/product/B0881F9LKF

I can't say it's been over used... probably about 6 or 7 times since purchasing it.. and to my knowledge it's never been allowed to sit in rain or moisture.

Do I have any rights, or just do I just accept it broke and get a new one?

    You have rights against the retailer, but you'll have to decide whether it's worth pursuing them.  First thing is to approach them and explain the situation.  They may offer something straight away.  If they don't, you could then exercise your rights, which would involve paying someone independent to inspect the item, and if it's deemed to have been faulty, Amazon have to partially refund you, replace the item or repair it.

    If it was relatively inexpensive, you might decide not to bother.

    And don't bother quoting the Sale of Goods Act, that was was replaced about 5 years ago.

    You definately have rights under the Consumer Rights Act - an item should be of satisfactory quality, one aspect of which is durability.  There is no fixed length of time an item should last, and it obviously varies with factors such as the nature of the item and the cost.   A piece of gardening equipment should last longer than 11 months.

    However, as it's older than 6 months, the retailer can ask that you provide evidence (e.g. a report from a 3rd party) that the failure is due to a manufacturing defect rather than, for instance, mis-use or improper storage.

    Whether it's worth the effort (and risk as you'd have to pay them to do that) to get someone to look at it, is another matter.

    For £35..... probably not.

    Agree with all the above, and I'll just add that if you're going to replace it with something, don't buy another electric weed burner, they're really are pants in comparison to a gas powered one.

    It bought a heated pad from Amazon directly.  It stopped working just before the year was out.  They sent me another one, didn't want the original back.  The same thing happened twice more  

    I sent the third one back to the manufacturer in the U.K. and they repaired it and told me I wasn’t using it correctly  :D

    Amazon were concerned that I had such a bad experience they refunded my original money and I bought a new heated pad, different brand.  

    Had no problems since.

    Thats what I call brilliant customer service

    Talk to Amazon on chat,bet they will have a replacement for you,my 2 year old one works great.

    More than likely it's got a 12m manufacturers warranty on it. Look at the t and c's.
