External cladding - SA12 Energy Services - Damage to home

Hi everyone,

My parents live in a two-storey home.
In 2014, a scheme backed by the government offered external insulation to properties in the area.
The company was SA12 Energy Services.
Soon after, it went into voluntary liquidation.
Soon after that, problems started to develop with the cladding...

REAR OF THE PROPERTY:
In the single storey extension, water penetration has caused significant damage to walls and ceilings. When it rains, water visibly penetrates the roof.
In the livingroom, opposite the single storey extension, water is penetrating through the roof and the ceiling next to the single storey extension is discoloured.
In the bedroom above this is area, the wooden floor is now sagging.
Also, in this bedroom, on the wall next to the extension, there is further water penetration
causing damage and mold from the floor to the ceiling.

SIDE OF THE PROPERTY:
This entire area needs to be removed and parts are starting to fall off.

FRONT OF PROPERTY:
This entire are needs to be removed. Cracks are starting to develop.

HOME INSURANCE COMPANY RESPONSE:
The insurance company, Aviva, are refusing to pay out because they claim it is due to poor workmanship.

"ENERGY COMPANY OBLIGATION CONSUMER PROTECTION POLICY":
As part of the contract there was some form of guarantee/Warranty included.
It is administered by QANW (Quality Assured National Warranties).
However, it limits liability to £6,000 and only in relation to removing the cladding. There is NO liability under the policy document for damage CAUSED by the cladding.
The estimated cost of removing the cladding is about £15,000 and the estimated cost of reparing internal damage is about £10,000.
This is a total cost of £25,000. If it is not done the house will continue to deteriorate rapidly.
It has taken us several years for QANW to even accept liability and we had to hire experts to provide the relevant evidence. During this time the home continued to deteriorate because of the cladding.
I can upload a copy of the Energy Company Obligation Consumer Protection Policy if required.

I would welcome any advice on this matter.

Thank you.

Not much advice I can give but how was it paid for ? Is there a credit company involved anywhere or was it all paid cash ?

If you use Reddit there is an excellent LegalAdviceUK sub that you could post to. They’re very helpful there.
  • Hi,
Thank you both for taking the time to reply.
Orangecrush - ok that sounds good will check them out. Many thanks for the heads up.
K3lvc - This is a mystery. It was administered by the Government NEST scheme for energy efficiency but when we contacted the government department they claim we are not on the list of people who were part of the scheme. However, we paid nothing for the external cladding and building work. So someone did. There is no legal documentation apart from the insurance policy/warranty.
