Worried about CCJ

Hi all
apologies the late post on a Sunday evening.

My husband and I would like to buy our first home in a few years, starting to save after our holiday next year.
We’ve both opened LISAs to start us off, and on Tuesday we thought we would have a look at our credit scores out of curiosity.
Mine is fine, however my husband has a ccj on his from November 2021.

This came as a shock to us,especially as the ccj is for united utilities. My husband has never been on the water account, only me.

So after a little digging we found out that the ccj was from our old address that we moved out of in August 2020.

The united utilities account was opened in January 2021, 5 months after we had moved out of the house.

We have spoken to UU who asked for proof that we wasn’t in the property at that time so I sent in our council tax bill to show the dates we moved out and moved into our new house.
They said they will get it sorted and have the ccj removed. How likely is it that this will happen? What will happen to my husbands credit score when this is sorted?

Also, we’ve only just realised that in March this year, my husband had a detachment of earnings taken off his wage for £438 which is the amount of the ccj.

We thought it was for a tax credits overpayment from a few years ago so didn’t think twice about it.
Now we’ve just realised that it was for the ccj. What can we do about this?
Will we get this amount back?
any advice or positive stories will be really appreciated. I’ve spent most of the day upset and we can’t even call them until tomorrow.

Thank you

Your husbands score will drop. But that's fine, as the score isn't used in lending.

Lenders will no longer see the CCJ, which will reduce the risk in their eyes.

You can`t just remove a county court judgement, there is a legal process to follow, they should, as it was their error, agree to a set aside by consent, and foot the cost of this also.

You will need to ask them to refund the money that was taken, as the debt was not yours.

I am a tad uncomfortable with their response to this matter, as it requires a lot more input than just a simple "we will sort it", I suggest you put all this in writing to them, so you have a paper trail, and keep on top of what is happening, as you may need to take action your self to have this removed and apply for costs against the other party, see how things develop.

Thanks for your reply. Why would his score drop if it’s been taken off? Thank you

Credit scores react negatively to change. It doesn't matter if the change is good or bad.

That's why they're not used in lending decisions, as they're not a reflection of your credit worthiness. They're just a comedy gimmick for your own entertainment.
