    They can block access to stop us from using a shared access gate to the front of the house, seriously!! The access is a tunnel from the front between neighbour next to us and another neighbour which leads to both their gardens and unfortunately for us we are mid terrace so we have shared gates/access with the neighbours who have a problem with this. We have lived here for 12yrs with no problems from any neighbour. Just also to note we do get delivery drivers who will leave parcels in back gardens.
    What do the housing association say?  Do they own both houses?  Please answer those questions before saying anything else, it is far and away the most important factor.

    I presume the deeds for your house can be downloaded from the Land Registry site like any other? As can your neighb's. For the little cost involved, I'd do that, highlight the relevant parts, and either approach your neighb or have it handy the next time you cross their garden 'without' a bin.


    Surely if the HA own both properties it is irrelevant what the deeds say?  They can give their tenants whatever rights they want over their  land.

    ...subject to any covenants the HA/LA is subject to as owner.

    As per previous post HA said that neighbours were incorrectly told it would be bin access only by a new member of staff. For decades it has always been shared access and at one point, long before I was even born it was one big communal garden. HA own all 6 houses in the terrace. Nobody living here owns these houses. HA are unaware that the gate has now been blocked as we have had to find an alternative route to access our garden. My point is why should we have to change something that has been the way of it for decades because neighbours are clearly out to cause trouble, fortunately for them we are not a confrontational family. Does that clear up your question, can I say something else now, it’s people like you who make me reluctant to ask for advice on forums without getting burned at the stake, I’m only asking for advice before I get intouch with the HA again.

    So if the HA say that the neighbours were incorrectly told - and they used the word incorrectly - they are saying you do have access.   As they are the owners, that's all you need.  Tell them sort it out.

    The reason this matters is that if the HA are telling you the neighbours were correctly told, it's a whole other issue.  And if they don't own your house, it's another one again. Without the information I asked you to give nobody can give you any advice of any worth.

    For someone non confrontational you seem very quick to attack someone actually trying to help you get what you are asking for.

    Oh come on, how can I attack, we are sitting behind keyboards not knocking on neighbours doors to start an argument,  I was simply commenting on your post where you told me to “please answer those questions before saying anything else” this is a forum where I am looking to gather as much advice on my issue as I can, you do not know my character, so let’s just leave this here.
