I think you should register your situation with Keller Postman (search the forum) because your example sounds like one of the unusual ones that they are looking to pursue as a group action, even after the recent ICO decision.

You could also (separately) send a LBC to the DVLA then a CCBC small claim, but it's an uphill battle and you must plead the claim properly, in a way that states in legal terms why they owe you a specified sum of money.

@zhonguonuren has successfully sued the DVLA I think - she might have something to add when she sees this.
