Before you go in with ‘guns blazing’, you might wish to read this technical bulletin from Worcester Bosch which suggests that expanding foam can be used as a flue pipe sealant.

Yes, I see what you mean, although the worcester-bosch literature mentions foam is acceptable when talking about the outside walls, I can't see there's any mention of using foam on the inner walls. This is why the engineer had a problem as the foam is inches away from the top of the boiler.

The way to go is to wait and see what the developer has to say. The situation is practically as clear as mud.

The flues are pvc now, They don't get very hot, The only concern here should be that its missing on the outside. Fire foam is usually a red/pink but its not even needed here.1
