hi all! me again!
I have had some hassle with landlord as i have previously posted, we will be moving out next month - already have a house rented, ready, my husband has come to the conclusion that the landlord is going to come up with anything possible to get at us and give us hassle getting our deposit back - I am inclined to agree judging by his behaviour lately... our last rent payment should be the end of this month... hubby wants to not pay it and tell the agent to take deposit as last months rent. I have not read into detail any posts on these lines... but i am a little worried that it is not allowed, and we could be in trouble for it. I really don't want to get in trouble, the deposit was a months rent plus £100... hubby says he would rather just lose £100, than £600... anyone got any views on this? husband is dead set against paying up the last month :confused:

  • Landlords cannot withold deposits, unless the amount retained is to cover damage to something shown on the inventory.

    For agreements that began after April 2007 the deposit is protected, anyway, and there's a dispute system to resolve any disagreements.

    If your agreement began after April 2007 then you are in a stronger position. But even if it began before then, the LL still must have a valid reason to retain any part of the deposit.

    If you want to play this one strictly according to "your rights" and "the law", then pay the rent and see what happens re the deposit. Post back here if there are problems with the deposit - and get everything in writing.

    This is probably the wrong advice and I expect to be slated for it by landlords, but I agree with your husband, especially if your new tenancy is signed and sealed and you won't need a landlord's reference. It is what I would do, anyway.
    I used to think that good grammar is important, but now I know that good wine is importanter.
