Poor Patio Job

I've recently had a new patio laid. At the time of completion, it seemed an ok job in terms of quality.

A few weeks since, blotchy patches have appeared on the slabs. After some research, I have confirmed that this reflective staining which is irreversible and categorically a symptom of the slabs being incorrectly laid.

To verify this, I invited a family friend (who is a landscaper) to take a look. He has confirmed my observation but also uncovered a whole raft of significant errors - including a loose step which is a health hazard.

I have informed the contractor of these issues and await his response. I have offered him the opportunity to come and visit to see how he can rectify these errors. With the staining, new slabs will be required.

However, given the breadth of these faults, I do not trust him to be able to do this to the standard we require - I'd much rather a 100% refund.

I have already paid for this job (£3000+). There was no contract. Just an email with the quotation typed.

I have a record of all messages and transactions between us.

In the event he will not rectify / refund, wanting to learn what leg I stand on. Do I have a case here?

    You need to wait until the contractor has visited and ask them what they intend to do to rectify the problems. You could ask for a discount but unlikely you will get a 100% refund.

    You do have a contract. You have paid this guy and so there is a contract, regardless of what you’ve received in written form. Contracts don’t have to be written down. 

    You wont be due a 100% refund, that’s completely unrealistic. You need to allow the contractor the chance to remedy the faults and if no joy, then you can take further action.
