Brooksdale HMRC

I find myself also awaiting payment from Brooksdale - re a HMRC overpayment. Used The Claims Guys several years ago for a PPI claim, not knowing what I was agreeing to. Does anyone know how to handle this apart from asking Brooksdale to revoke this ‘agreement’ .. is it for a fixed time or will they forever have access to all tax related rebates ?? Thank you

  • If it involves a deed of assignment they will forever be entitled to any income tax refund due for the year(s) covered by the assignment.

Even if it doesn't come to light for some time yet.

You have to get Brooksdale to agree for an assigned to be revoked.

    This is worth a read.

  • A win against Brooksdale Ltd!!! 🎉

My mum told me that she’d been contacted by Brooksdale a couple of months ago; they claim she instructed them via a Facebook ad earlier in the year.  She has no recollection of ever dealing with them or signing up for tax rebates as she does her own tax returns.

Anyway long story short and many emails later I think we’ve got a win.

Firstly I used Chat GTP and Grammarly to help me write a letter to Brooksdale on behalf of my mum. It was a great letter 😁. I’ll see if I can post it later as it might help others. It basically said there was no permission given to Brooksdale to act on mum’s behalf and that if they claim to have this then they must supply any and all documentation related to this. I then went on to say that Brooksdale had no permission to act as an agent in any and all tax related affairs on behalf of mum in the future and were to be removed from her HMRC account.
I then went on to instruct brooksdale to return all monies to HMRC so mum could claim them herself directly as she had done every year in the past.

I also sent a copy with a letter to HMRC telling them Brooksdale have and never had permission to be an agent on mum’s behalf and to remove all agents from the account immediately. I also asked them for copies of the permission they had but not had anything back from them.

Well, the “evidence” Brooksdale sent was laughable. Screen shots of their account info for mum, an IP address which was for an EE sub-hub in the middle of London and some 40+ miles away from anywhere mum had been at the time they claim she signed up, supposed log entries for actions taken by mum to instruct them which had not one personably identifying piece of information amongst it and an HMRC tax claim form with an “electronic signature” which was two weird lines that in no way shape or form matched any part of mum’s signature.

So I went back to them and told them that not one piece of what they’d sent identified mum and that it was just as likely to be someone ordering a Starbucks through JustEat.

I also addressed that they hadn’t mentioned returning the monies to HMRC and I gave them 5 working days to confirm this was actioned. I must add here that I had given reasonable timelines previously in all correspondence but they failed to adhere to these (to begin with) so in my last two emails I advised that if they didn’t respond by the deadline I would be passing everything to every governing body they were subject to as well as mum’s MP. They started to respond within days rather than weeks after that.

Well, this morning, two days after my last email, they’ve said the monies will be returned to HMRC through their finance department but no timeline can be given as it is a “long winded” process on their end. I’ll give them till the second week of January then chase them.

I’ve told mum to take this to her MP regardless as I believe there is not only illegal activity by Brooksdale Ltd but also bad practices going on with them, HMRC and Action Fraud who all seem to be passing the buck, accepting frankly blatant fraudulent signatures and “jargon” at face value and not listening to the overwhelming voices of those affected.
  • Here are the letters I initially sent on behalf of mum. First one to Brooksdale Ltd and the send was sent with a copy to HMRC. Might be of help to someone.

Subject: Request for Proof of Authorisation and Withdrawal of Consent for Tax Rebates

    Dear Sir or Madam,

I am writing to address a serious matter concerning a tax rebate that HMRC has processed through your company. After conducting an investigation, I discovered that my personal details and authorisation to act on my behalf in tax-related matters were allegedly transferred from a PPI claims company without my knowledge or consent.

To the best of my knowledge, I have never explicitly authorised or signed any documents permitting Brooksdale Ltd to represent me in tax rebate claims. Given the gravity of this situation, I kindly request that you provide me with all documentation and proof that substantiates your claim of authorisation to act on my behalf in tax matters. This includes any signed agreements, correspondence, or other relevant documents.

Furthermore, I want to make it clear that I do not grant Brooksdale Ltd permission to act on my behalf in any tax-related matters going forward, nor do I permit them to forward and/or sell my information to any other party. Previously, I have managed my own tax returns or engaged the services of a personal accountant for this purpose. I am concerned about the potential misuse of my personal information and want to ensure that no further actions are taken without my explicit consent.

In light of this, I am formally requesting that Brooksdale Ltd return the funds received from HMRC in connection with the recent tax rebate. I expect this process to be expedited, and the funds returned to HMRC without any delay. Please provide confirmation once this has been completed.

Please provide the requested documentation and confirm in writing that you acknowledge my withdrawal of consent for your company to act on my behalf in tax matters within 7 days of the date of this letter. If you have any questions or require additional information, please contact me at

Thank you for your prompt attention to this matter. I trust that we can resolve this issue amicably.

    Sincerely,

Subject: Withdrawal of Authorisation to Brooksdale Ltd

    Dear Sir or Madam,

I am writing to bring to your attention that I have never authorised Brooksdale Ltd to represent me in any tax-related matters. I have not signed any documents allowing them to act on my behalf, and I do not wish them to do so in the future.

I have requested that Brooksdale Ltd provide all documentation and proof of authorisation that they claim to have. This includes any signed agreements, correspondence, or relevant documents. I believe that any signature on these documents has been applied fraudulently. I also request that HMRC provide all documentation and proof of authorisation they have from all agents on my file.

Furthermore, I would like to point out that I have requested any funds that HMRC has paid to Brooksdale Ltd for tax refund purposes to be returned to HMRC. I would like to claim these funds myself or through my personal accountant, as I have done in the past.

Kindly confirm in writing that you have received and understood this information. I request that Brooksdale Ltd be removed as an agent on my file immediately.

Thank you for your prompt attention to this matter.

    Sincerely,
