Notice of impending prosecution - speeding

Received the notice today for alleged offence 10th June 37 mph in a 30 limit. The letter is from North Wales Police however it was not me as the location is over 100 miles from where I live and I was not in Wales that day and nobody else had access to me car. My car was in my workplace carpark  that day. What do I do?

    Cloned plate? Can you prove where your car was that day?

    Contact them and tell them and ask what evidence they need to confirm your car was in the workplace.
    It's the motor they are interested in not you as people do share their car.

    They then may verify the trip the cloned car made and if they are two cars  with the same plate being picked up in different locations of the UK. via the excellent APNR cams dotted all over the UK.

    I had a bus lane pcn. This is years ago. I just told them I was at work is se London and not near Heathrow and though it would take time I could get evidence via our works carpark plate readers etc. They sent me a letter to saying disregard the pnc that was the last of that.


  • You need to at least reply to the prosecution letter which forms part of your evidence. Usually gives you somewhere to signor do it digitally, but that must be done as it’s a legal statement. If you have a keyfob or something like that to enter car park, if you can get prooof you can send that, otherwise I have known people who have given copies of shift pattern etc as evidence. Attention court if you have to, as the magistrates do listen,, 
    for the future get a circle reflective sticker and put on top left or right of back window, or as the police do some form of sticker . If camera flashes it again you can show you have done this and it’s not your car.

    Do I need to fill the form in return it? Difficult to prove my car was in the carpark but I am sure my boss will confirm I was in work that day. Even if my plate has been cloned it wont be the same model and colour will it

    They may confirm via  APNR camera so you need to ask what evidence they want but repsond to their contacts.

    Yes probably. If I wanted false plates for any car I'd look up the same make & model on autotrader and copy a reg. That way if an ANPR police car passes you, the 2018 silver ford focus you were illegally driving would come up as a 2018 silver ford focus and not a 2017 Fiat 500.

    However a photo of the rear of 2 similar cars may well show some subtle differences.

    If it is cloned and not a mistake then prepare for more trouble of similar nature.

    I think I will start by contacting them on Monday. helpfully the phone line is open 9am to 12pm Monday to Friday. We do have CCTV at work but not sure if it covers the carpark

    Why? It's not compulsory to have it in a works car park. I don't know why you think a shot possibly side on of a car from a ring camera is evidence.

    Yes you do. Failing to reply to the S172 request is an offence in its own right, whether or not you were speeding, or even at the location in question.

    If the form doesn't have space to say that your car was not at the location on the date in question, write "see attached letter" on the form, and attach a letter saying that your car was not there, and where it actually was. 

    While cloned numberplate exist they are not particularly common and a simple misread of the numberplate is probably more likely. In which case it will all be sorted out very quickly once a real person looks at the photo.

    If it isn't sorted out quickly then technically it is for the police to prove that your car was present, not for you to prove that it wasn't, although any evidence you can provide to show that you were not there (statement from your boss's to say that you were at work, CCTV if any) obviously helps your case.
