Ebay GSP - Lost item / still in transit Ebay holds funds - Hidden Terms and Conditions .




Sold an expensive Item to the  USA using ebay GSP , it was delivered to their depot and signed for then sent overseas using their courier , I thought this is where my responsibility ended in regard to the delivery as per the the terms and condition but Ebay says different  .

The buyer opened a case as the item has not been delivered and funds are now being held , it has been tracked at 20 different locations according to ebay / buyer .


When I contacted the live help stating that it was their responsibility to deliver the item and the funds should  not have been frozen ,  was told that  Ebay has Terms and conditions when using GSP which are only available to read by them ( ebay )  not by the customer  signing up  , is this Legal ?

I signed up to use the service based upon the terms and condition which was provided at the time , not ones which Ebay decided to keep to themselves just in case a problem arises with the delivery .

Why bother having the terms and conditions if they overridden by ones that are not provided .

Cannot be legal , can it ?

    as long as you have delivery confirmation to the ebay hub then you are covered, you need to go back to ebay and point out their own terms and conditions to them.(I'm assuming your item was eligible)

    • You aren't responsible for item loss or damage that occurs after the item reaches the UK Shipping Centre. Once an item has been forwarded by the UK Shipping Centre, you won't be responsible for refunding the buyer if an eBay Money Back Guarantee or PayPal Buyer Protection case is filed against you for one of the following reasons:
      • A buyer claims an item isn't received or a package is damaged in transit
    I am always shocked how little some of the CS reps at ebay actually know about the terms and conditions.

    Thanks , I have spoken to live help and  phoned 3 times this week and pointed that their terms say that I will not be held responsible for lost or damage in transit  which they agree to but they still allowed a buyer to open a case .  

    I pointed out that " the case should not have been allowed to be opened or closed straight away once they checked that it has been accepted by the GSP " and that " is their courier not mine who are at fault "  but they said if it keeps showing up every 10 days on their tracking  the funds will be held and cannot be classed as lost  - for months if needed .

    I asked " are telling me that you have terms and conditions which the person using the service cannot see? The answer was YES .

    Its over a £1k which is being held / frozen .
