There are new rules from July regarding statute barred debt. They will not be allowed to pursue people as they currently do.
So DCAs are desperately trying to get payment or acknowledgement from people whose debt will shortly become statute barred. As they won't be able to keep contacting them later in the year.If you've have not made a mistake, you've made nothing2 -
Thanks for the info, I didn't know the rules are changing. I seem to have been dealing with my husband's debts forever and will be glad when this final one has gone.0

Just received Link's Statement of Account and notice the balance has been reduced by £1. I'm assuming this is the £1 sent with the letter requesting CCA in June 2022. This request hasn't been forthcoming or acknowledged.
I'm hoping this doesn't mean the debt has been acknowledged and reset the 6 year rule?0 -
Basically in short they are not going to be able to take any further action in enforcing the debt until they are able to provide that information to you.
In regards to the fact that they have not replied in so long and took the £1 to go towards the debt even though it was clearly not for that you could consider making a complaint about them.
It is always best to complain in writing (email or post), so you have a record of what has been said. Try to clearly explain what the problem is, and how you would like this to be resolved.
If you are sending a complaint by post, use a ‘signed for’ service so you can prove that it has been delivered.
If they take longer than 8 weeks to respond, or you are not happy with their response, you can consider escalating the matter to the Financial Ombudsman Service (FOS). You normally have to complain to the FOS within 6 months of receiving a final response. This is a link to the FOS - https://www.financial-ombudsman.org.uk/

My husband's credit file is showing 2 hard searches by Link Financial, both on 21/04/2023.
Regarding the CRA request not been forthcoming or acknowledged and the £1 sent being used towards the debt, I've not made a complaint as you advised.
I had a long chat with National Debt Line, who were very helpful but left me totally confused about the best way to proceed.
I fear Link is not going to let this one go!0 -
Fear is not an option, you don`t give up at the first hurdle, there are usually many battles to fight before the war is won, and you need to tackle Link on each individual aspect of their non compliance.
The first step would be to lodge a complaint about their refusal to respond to your CCA request, take it all the way to the ombudsman if need be.
Its very likely no paperwork exists for this debt, many egg accounts were unenforceable due to a lack of paperwork, companies such as Link know this, so throw boulders in your path, hoping you will give up, please don`t, as this is how you beat them, its the little things that matter, no paperwork equals no liability.
Please lodge that complaint.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
