urgent xbox 360 problem

ok, so i was playing the xbox yesterday, playing fifa 08.

it was all going well till i had to go downstairs, so i paused, went down, came back up and accidently knocked the xbox over. not completely over tho it was about a 45o angle cos it was leaning on something. so i placed it back as it was (i keep it vertically). thought nothing of it. carried on playing

then a message came up "unable to read clean, please clean" so i thought ok, took it out and went to clean it. there are deep scratches on the disk in the form of circles, small to big from the inside of the disk to the edge. completely ruined.

i only had this xbox on wednesday (its an elite) so only had 3days use of it.

anyway, i rang my mate who also has one and he said one of his did that too when he had his first, but when he took it back to asda where he got it from, they asked "what way did you have the console" he said "vertically" they told him he shouldnt do it like that and did not refund/exchange the game.

so as i got mine from game i dont know what to do, im busy for ages now, apart from today so will go soon to the shop. but i bought it online.

how can i get the game exchanged (i still want the same one)?
will they do it?
what are my rights?
do i need to lie? (the manual says nothing about which way to keep it, infact there are rubber things on the side and edge indicating you can store it either way round, pcworld even have theirs vertically)


dont want to pay £40 for a game i already have!

    i know what it may seen like (that ive had the game ages)

    but i have delivery not that has the 10th as day of delivery!

    Be warned .. this is a well known problem with the 360 so lying might not get you anywhere as they will have seen this all before..

    Some places will replace the games if it has been damaged by the XBOX (Game did it for me twice)

    so what do you suggest i tell them? that i had it on its side or lie and say i kept it flat?

    if i say i had it on its side they may say that was wrong so no

    It isnt wrong and can be used both ways... Your mate was obviously fobbed of with a chancer instore

  • I had a scratched copy of Gears of War. I read on the xbox live forums that this could be fixed with T-Cut. I didn't have any but had some Megeuiars Paint Cleaner (similar stuff). I cleaned the disk surface with this, put it back in the 360 and as if by magic, it works again!!
    I really didn't expect it to work but it does. I have used this disk every night for a week now and no further problems.

    i went into game and was told that they wont replace it at all. they said although it is a fault microsoft wont accept this and therefore wont replace/refund the retailers who refund customers.

    therefore i cant get it exchanged! £40 if i want another copy, just 3 days after paying £340 for it. its ridiculous!!!


    they said the only thing i can do is take it to gamestation and they will do some clean thing to it to resurface it or something, so i did £2 and the girl tried it 3 times. she said to me "i will refund you the money because ive tried 3 times now and it still is too bad, if i try it again the disk will be completely ruined. normally it works first time but ive never seen one this bad - i can feel the scratch with my finger"

    so it will never work again :(

    what are my rights? surely game must refund me as i bought it from them, am within the 10/14 day return period, there is a fault obviously with the machine etc... and i dont want to pay again
  • The equipment (Xbox) is not fit for purpose if it damages games so quickly and as such you are entitled to a refund or a replacement(under the sale of goods act). Best bet would be to write (recorded delivery) to head office/complaints branch stating that you want a refund/replacement of both the game and the xbox (as it's likely to do it again). Give them a time period in which to sort it out (say 2 weeks) and at the end mention that if you do not get a satisfactory response to your issue you will have little option but to pursue a legal course of action to reclaim your money.

    The monkeys in the shop will try fob you off but the folks at head office should know better.

    well the op did knock the 360 over. So i don't see how the sale of goods act comes into it.
