Rights on partial refund for car

Options
Hi,

I bought a used car from a main Mercedes dealership on 31 May 2022. Myself, 2 family members and 2 of the salesmen noticed a few scratches so the dealership agreed they would be sorted out. It was agreed I would be contacted within a few days to get booked in. The same evening I purchased the car, 1 of the badges from the back had fallen off. Within a few days, I noticed the car had a few worrying noises. I wasn’t booked in until 10 June 2922 apparently due to the bank holidays. I was offered the car of the salesman I was dealing with but I said no as it was for 1 day. I was vaguely updated midday but then nothing further until around half 5 in the evening but the dealership closes at 6:30pm. The car needed parts so there was further work needed. I was offered to collect my car but would be required to return it on the Monday for the further work or take a courtesy car or neither of the above. I opted without collecting my car and no courtesy car on the basis the jobs would be complete on the Monday. Monday came and the salesman at 12:45pm advised a technician would call be with an update which didn’t happen until 18:15 when the dealership closes 15 minutes later. Told the car would be all done towards the back end of Tuesday. No update whatsoever on the Tuesday. I had to call up, no one available to talk to, requested a call back to which I didn’t receive. I didn’t have the car even 2 weeks, the dealership will have it nearly a week for problems they admitted should have been fixed prior to me driving the car away. Im just wondering if there’s any way of me to request a partial refund of my first monthly payment of my PCP plan since the car hasn’t been in my possession due to faults of Mercedes’. Is this something that I can actually ask for? Any help or advice at all would be such a huge help. Thank you

You can ask for whatever you want.

I doubt you will get a PCP refund as the finance won't be directly from the garage.(I may be wrong)

You can ask the garage for compensation to offset your payment though. What you can't claim for is not having a vehicle if you have rejected a courtesy car. Well you can claim but they will just say you were offered an alternative whilst works are done.

As they offered you a courtesy car for the period I am not sure what you are claiming for as you would not have been without a vehicle. It was your choice by the looks of what you read to turn down that loan vehicle.

Have they still got the car? do you have a loan car now?

You need to get out of the mindset that the PCP monthly payments are a cost for renting the car for a certain period. The monthly cost does not represent a month of using the car.

The PCP is simply a finance product to help you finance the purchase cost of the car. No more, no less. Therefore any compensation you are owed has no correlation with what you pay monthly to finance the purchase cost of the car.

As above, you were offered a courtesy car, and whilst you declined on the basis that the work would be finished sooner, this is just the reality of poor customer service from main dealers. You can ask for some sort of good will for the inconvenience. Perhaps they will give you a voucher towards a service or something.

There may be problems getting the parts they need.

If you had a courtesy car that may make them try harder to get yours fixed since they will want it back.

Yeah as stated above your pcp agreement is purely a loan secured against an asset which happens to be a car. The finance company don’t care whether you are using that car or whether it works or not. You are paying back a loan and therefore they have absolutely no responsibility for the car or it’s viability.

The dealer might do a goodwill gesture but expect it to be small. They offered a courtesy car and you declined. That’s pretty much what they would offer and frankly you should have taken the offer of it up.
