Sold a car but it had finance.

As careless as this is, the seller didn't have clear title to sell. This could get very nasty, as it wasn't his or his ex partner's mother's to sell. The easiest way of making this go away is to settle the finance. Thanks. I still find it incredible re both sides even if there was lack of communication between the seller and the person that originally bought the car on HP. I hope it works out for the OP and anyone reading this will not fall into this scenario.ontheroad1970 said:

Why not see if the finance company will convert it to a personal loan and release title to the car?
Otherwise the simple fact is you've sold a car without title and the dealer is entitled to be put back in the position he was before or to have the implied breach of contract remedied.
But then, how much is the car worth in full working order? Could you sell on yourself, paying off the finance at the same time, then have any left to cover the dealers losses?0 -

Whatever, the OP/OP's MIL/partner should make the settlement payment and send evidence of such to the buyer to demonstrate that the finance company no longer own any interest in the car.0
