Hi a relative missed a deadline to cancel an holiday due to family bereavement and TUI have explained their policy is only 70% of money is refundable. The full cost was £3300 and they have now refunded £2300 with the remaining non refundable, I am wondering could they have asked TUI for a credit note for this or have they lost it?

    They'll only be refunded the amount which is refundable. 

    Use your travel insurance to claim for the remaining losses.

    Travel insurance may cover cancellation due to death of close family member who was not travelling and  death was not due to a pre existing condition.

    Travel insurance was not taken out.

    The TUI policy is that the 30% is regarded as a cancellation fee - it's possible that they may have been willing to negotiate on it at the time of cancellation, e.g. they might have been prepared to offer, say, £2500 credit instead of £2300 cash refund, but it seems less likely now.  No harm in asking but they shouldn't get their hopes up....

    If memory serves, the client is obliged to tick the appropriate box in the affarmative to proceed online with the reservation.

    Yes, you'll need to take out a suitable insurance policy for you and anyone travelling with you - including infants and children.

    We can't accept responsibility for any loss that you or anyone travelling on your booking suffers if the individual isn't adequately insured. With all insurance policies, terms and conditions apply, so you need to make sure you've got the right policy for you.

    Then the relative is rather silly, insurance should always be taken out as soon as the holiday is booked. 
    They’re stuck with the 30% refund I’m afraid.

    Not taking out travel insurance is a self inflicted gamble in my opinion.
    Better to have it and not need it - rather than vice versa.
    Other opinions may differ.
