Received a fine from Parking eye but we paid the parking fee

Hi

Please can you help

We received a letter from Parking eye with a £60 charge for not paying for parking at a visitor attraction in Scotland

We sent them proof that we have paid but they have come back to say that we didnt pay enough and need to pay the charge

We paid the amount that the ticket machine requested after we put in our registration number, we were there with our daughter who also paid the same amount for the period, but she hasnt received a letter, we have also today emailed the stately home that we were visiting to see if they can cancel the ticket

Where should we go now to get this exorbitant charge cancelled?

    In which nation does the keeper live?

    Has the identity of the driver been revealed?

    Are you able to get photos of the site and signage?

    Did you get a PoPLA code with ParkingEye's response?

    What is the precise location of the alleged event? It may have cropped up here before.

    Have you checked the location's website to see what it says about parking and tariffs?

    A landowner cancellation is always the best option, so keep on with that.

    The driver lives in Scotland and didnt state that he was the driver to Parking Eye, as they didnt ask

    We can probably go back to get photos of the signage and site at Abbotsford House Galashiels  as well as checking their website, the  parking charges are new there and there was a lot of signs explaining that the parking now needed to be paid for.

    Im not sure about the Popla code, I will need to check the letter that we received, will we need a code from them if there isnt one on the letter?

    Why is someone in Scotland replying to ParkingEye at all?  You don't have to appeal.

    Until keep liability comes to Scotland (not till late 2023 at the earliest) you are best ignoring, as all websites tell you.  Just forget it if the landowner won't cancel it.  Nothing will happen because almost no PPC ever tried the Scottish Simple Procedure and certainly PEye doesn't.  

    Be warned that you do need to be much more careful after 2023 and read every sign in car parks, and avoid them if possible.  Park on street and avoid overstaying.  Read EVERY sign.  Spread the word to family and friends, what we have is coming to you.

    But not for this charge.  Ignore.

    In which nation does the keeper live? (In which nation is the vehicle registered?)

    At the moment a keeper cannot be held liable in Scotland, which is why it is imperative that the driver's identity is never revealed.

    Note that this will change in the near future thanks to the Scottish government copying a law from south of the border that allows someone who was not in the vehicle at the time to be held liable for a parking charge from an unregulated private parking company.

    Thanks for all your help, the driver and registered keeper is my husband and we live in Scotland

    It seems that the consensus is that we can ignore the ticket as Parking Eye will not take legal action against us for a 50p ticket because we live in Scotland

    Can you please confirm that this is correct and I will file all their correspondence?

    But change your parking habits and read signs, in readiness for the change in 2023.

    It's the position in Scotland that there is no Protection of Freedoms Act 2012 (Schedule 4) through which parking firms can hang liability for a parking charge on the registered keeper of the vehicle. Unless the parking firm knows who the driver was, they have no legal basis on which to pursue the keeper.  
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
